Gigabit expansion with Bavarian co-financing, application for funding
The Free State of Bavaria is promoting the expansion of gigabit-capable networks.
Description
Purpose
The purpose of the grant is to support the expansion of gigabit-capable broadband networks in the Free State of Bavaria.
It supplements federal funding and is intended to help provide a high-performance digital infrastructure throughout the state.
Object
Funding is provided for expenditure incurred by municipal grant recipients as part of the federal funding for gigabit expansion.
This includes in particular
- Closing a profitability gap for private-sector network operators,
- the implementation of an operator model for the expansion of passive broadband infrastructure and
- projects to close gaps in existing network infrastructures.
Funding is provided as co-financing for approved federal funding.
Recipients of funding
Funding recipients are municipalities, mergers of municipalities and associations of municipalities in the Free State of Bavaria.
Eligible costs
The eligible costs are those recognized as eligible in the grant notification in accordance with the Federal Government's Gigabit Guideline 2.0.
Type and amount
The funding is granted as a subsidy.
The type of grant is project funding.
The grant is awarded as project funding by way of pro rata financing as a non-repayable grant based on the eligible expenditure. The basis is the expenditure that was recognized as eligible for funding in the federal grant notification.
The Bavarian co-financing supplements the federal funding. The aim is a total funding rate of
- 80 % of the eligible expenditure for municipalities in the conurbation outside the area in need of special action
- 90 % of eligible expenditure for municipalities in rural areas or in areas requiring special action.
The amount of Bavarian funding corresponds to the difference between this target funding rate and the federal funding rate. The federal funding amounts to at least 50% of the eligible expenditure.
Special regulations apply to operator models:
- For federal funding applications submitted by 15.11.2024, the funding rate is reduced by 15 percentage points if the average eligible expenditure is more than EUR 7,500 per address. However, funding will be granted on the basis of at least EUR 7,500 per address.
- For federal funding applications submitted after 15.11.2024, the funding rate will generally be reduced by 15 percentage points.
- The reduction does not apply if an originally planned economic viability gap model could not be implemented due to a lack of economic offers and the project is implemented in the operator model instead.
A case of hardship exists if the local authority's own contribution to a project would amount to more than 30% of the average financial strength of the last five years. The Free State of Bavaria will subsidize 90% of the excess amount.

Prerequisites
Funding will only be granted if:
- the measure is funded in accordance with the Federal Government's Gigabit Directive 2.0 and
- a corresponding grant notification from the Federal Ministry for Digital and State Modernization or the commissioned project sponsor has been received in the final amount.
In the case of operator models involving several municipalities, funding can also be approved on the basis of a provisional federal decision with the consent of the Bavarian State Ministry of Finance and Regional Identity.

Procedure
The application for the grant must be submitted to the State Office for Digitization, Broadband and Surveying. The application must be accompanied by the grant notification from the Federal Ministry for Digital and Transport or the commissioned project sponsor.
If several municipalities or associations of municipalities submit a joint application, the eligible expenditure must be divided among the participating municipalities.
The approval authority decides on the application and grants the subsidy by means of a grant notification.
The grant is paid out in accordance with the ancillary provisions for project funding ANBest-K No. 1.3 or ANBest-P No. 1.4:
- The grant may only be requested if it is required for payments due within three months;
- When requesting a partial amount, details of the funding requirement must be provided.
- In the case of construction measures, the progress of the construction work must be taken into account.
After completion of the project, you must submit a proof of use to the approval authority. This must be submitted within one month of completion of the verification of use of the federal funding. The result of the verification of use must be attached.
Notices amending, revoking, withdrawing or reclaiming federal funding will also result in a corresponding amendment to the Bavarian co-financing notice. Copies of such notices must be sent to the granting authority.
Grants under these guidelines are awarded without legal entitlement within the scope of the available budget funds.
(Approval for the early commencement of measures is deemed to have been granted if the Federal Ministry for Digital and Economic Affairs and Transport or the project management organization commissioned by it has issued a grant notification or has in turn granted approval for the early commencement of measures upon application in accordance with the Federal Government's Gigabit Directive 2.0).
