Local public transport; receipt of aid for educational transport

In accordance with Art. 24 of the Bavarian Public Transport Act (BayÖPNVG), the local authorities receive annual lump-sum assistance for educational transport.

The municipal public transport authorities pursuant to Art. 8 BayÖPNVG receive assistance for educational transport pursuant to Art. 24 BayÖPNVG to ensure educational transport in general local public transport.

The aid for educational transport is granted as a lump-sum allocation to the public transport authorities, which pay the compensation to the transport companies that offer or provide local public transport services in the area of the public transport authority. The compensation payments are made for the financial effects attributable to the fulfillment of tariff obligations in connection with the discounting of season tickets for educational transport in local public transport.

The conditions for granting compensation to transport companies are determined by local regulations.

The local authority receives the aid for educational transport to finance the obligation pursuant to Art. 8 Para. 2 Sentences 1 and 2 BayÖPNVG.

The local authority must use the aid for educational transport for the specific purpose of ensuring educational transport in general local public transport. Insofar as the funds are not required to compensate for a shortfall in revenue in training transport, these funds must be used by the respective public transport authority for local public transport purposes in accordance with Art. 27.

Lawsuit

• The lump-sum advance payment is made on April 1 of each year.
• The remaining amount will only be paid out if the responsible body has submitted the required documents via the online portal (see "Online procedure") by September 15 of each year at the latest.

• Notification of the information required in accordance with Section 1 (2) sentence 3 FinÖPNVV: by September 15 of each year

• The proof of use must be submitted by September 30 of the following year.

• Notification of the information required pursuant to Section 1 (2) sentence 3 FinÖPNVV

• Annual statement of the inventory amounts required in the following year
