Foreign companies; notification of commencement of activities to the Bavarian Chamber of Engineers-Construction

Foreign companies, i.e. companies that are not entered in the register of companies of the Federal Republic of Germany, may only use the professional title "Consulting Engineer" alone or in a combination of words in their company name or in their name if they are authorized to use this or a comparable professional title under the law of their country of origin. If the object of the company comprises the professional tasks of a consulting engineer, i.e. independent and autonomous consulting and planning in the field of engineering, the first provision of services must be notified.

The registration committee may prohibit the use of the professional title if the company cannot prove on request that it or its shareholders or legal representatives are authorized to carry out this activity under the law of the country of origin.

  • Proof of authorization for the activity relating to the chamber in the country of origin
  • Proof of authorization to use the professional title "Consulting Engineer" in the country of origin
• Proof of sufficient professional liability insurance
• Memorandum or Articles of Association
• Proof of entry/registration in the Commercial Register or Partnership Register

• Authorization under the law of the country of origin to use the professional title "Consulting Engineer" or a comparable designation in the name of the company
• Provisions in the articles of association or statutes: "The object of the company is the performance of the professional duties of consulting engineers"
• Company complied with the professional duties of consulting engineers

The notification must be submitted to the Bavarian Chamber of Civil Engineers in text form before the service is provided for the first time.

The use of the professional title may be prohibited by the Registration Committee of the Bavarian Chamber of Civil Engineers if the company does not prove, upon request, that it or its shareholders and legal representatives are lawfully exercising the activity in question in accordance with the law of the country of origin

The notification must be made before the service is provided for the first time.
