Construction project; notification of the start of construction

You must notify the start of construction in advance. This applies to the start of execution of projects requiring approval and the resumption of construction work after an interruption of more than 6 months.

The notification of the start of construction is not an application. You only need to inform the lower building supervisory authority of the imminent start of construction.

The notification of the start of construction is intended to give the lower building supervisory authority sufficient time to prepare construction monitoring measures and to check whether the period of validity of the building permit has expired.

Consequences of non-notification

If you deliberately or negligently fail to notify the start of construction at least one week before the start of construction, you are committing an administrative offense. You can be fined up to EUR 500,000 for this. In addition, the lower building supervisory authority can order the suspension of construction.

You must notify the start of construction if:

• you start carrying out a construction project that requires approval,
• you resume construction work after an interruption of more than 6 months or
• you remove an installation subject to notification.

This also applies to a project covered by a partial building permit and to projects that do not require a permit.

As no decision is issued by the lower building supervisory authority, you cannot lodge an appeal.

Written submission

• Submit the completed and signed "Construction start notification" form with the required attachments to the lower building supervisory authority (district offices, independent cities, large district towns and certain larger municipalities).
• Verbal notification is not sufficient.
• You will not receive confirmation of receipt.
• The lower building supervisory authority will then check whether the period of validity of the building permit has not yet expired. It can also prepare measures for construction supervision if necessary.

Digital submission

It is not yet possible to submit notifications of the start of construction work digitally throughout Bavaria. When a location is selected, the link to the online procedure is displayed if it is already offered.

• The start of construction can be notified digitally to the lower building supervisory authority using the online assistant.
• The predefined forms "Notification of start of construction" and (if required) "Designation of the structural engineer responsible for the construction work" are replaced by the queries in the online assistant.
• Signatures are replaced by authentication using the "BayernID" user account or "My company account".
• The remaining attachments are uploaded in electronic form (files in PDF format) in the online assistant.

You must notify the start of construction at least one week before work begins.
