Electrical and Electronic Equipment Act; application for confirmation of sufficient professional qualifications for persons established abroad

The professional qualification required for the disposal of waste electrical and electronic equipment is verified and confirmed for experts established in other EU/EEA countries.

Experts for the disposal of waste electrical and electronic equipment established in other EU/EEA countries who only wish to certify primary treatment facilities in Germany temporarily and occasionally within the meaning of the German Electrical and Electronic Equipment Act (ElektroG) will have the necessary professional qualifications checked and confirmed.

Operators of facilities for the primary treatment of waste electrical and electronic equipment must have their facilities certified annually by an expert for compliance with the requirements of the ElektroG (technical requirements and requirements for the documentation of all primary data necessary for the calculation of recycling rates up to the recycler). Operators of primary treatment facilities fulfill this obligation if, among other things, they commission an expert who has been publicly appointed for the disposal of waste electrical and electronic equipment in accordance with Section 36 of the German Industrial Code to carry out the certification.

However, operators of primary treatment facilities also fulfill this obligation if they commission an expert who is established in another EU/EEA country, who only occasionally and temporarily wants to certify primary treatment facilities in Germany and whose professional qualification required for this has been verified and confirmed by the competent authority.

The operator of a primary treatment facility must ensure that another expert certifies the facility at the latest after five years of continuous inspection by the same expert.

• Proof of citizenship

  in certified copy and translation by a translator publicly appointed and sworn in the Federal Republic of Germany

• Proof of legal establishment in an EU or EEA country for the purpose of exercising the activity of an expert in the disposal of waste electrical and electronic equipment, and proof that this activity has not been prohibited, even temporarily.
• Foreign proof of professional qualification for an expert in waste electrical equipment disposal

  or, if applicable, proof of at least one year's activity as an expert for the disposal of waste electrical and electronic equipment in the foreign country of establishment during the last 10 years
