Batteries Act; application for confirmation of sufficient professional qualification of experts established abroad

Experts for waste battery disposal established in other EU/EEA countries will have their professional qualifications checked and confirmed.

In the case of experts for waste battery disposal established in other EU/EEA countries who only wish to carry out the expert activities specified in the Batteries Act (BattG) in Germany on a temporary and occasional basis, the professional qualification required for this is verified and confirmed.

In the procedure for approving a take-back scheme for waste portable batteries, the approval authority must rely on an expert opinion from an independent expert to determine whether the approval requirements are met (expected achievement of the collection targets and requirements for disposal and nationwide take-back, in each case relating to waste portable batteries).

The take-back scheme must commission an expert who has been publicly appointed for waste battery disposal in accordance with Section 36 of the German Industrial Code.

However, these obligations are also fulfilled if an expert is commissioned who is established in another EU/EEA country, only intends to carry out the expert activities stipulated in the Batteries Act in Germany occasionally and temporarily and whose professional qualification required for this has been verified and confirmed by the competent authority.

• Proof of citizenship

  in certified copy and translation by a translator publicly appointed and sworn in the Federal Republic of Germany

• Proof of legal establishment to carry out the activity of an expert for spent battery disposal in an EU or EEA state,

  furthermore, proof that this activity has not been prohibited, even temporarily.

• Foreign proof of professional qualification for an expert for waste battery disposal

  or, if applicable, proof of at least one year's activity as an expert for waste battery disposal in the foreign country of establishment during the last 10 years
