Residence permit; application to amend the ancillary provisions

If you are in possession of a residence permit that is subject to a residence regulation, you can apply to change the ancillary provisions.

If, as a foreign national, you are subject to a residence obligation for a specific location, you can, under certain conditions, have this residence obligation lifted or changed if you wish to move to another federal state.

To do this, you must submit a corresponding application to the relevant immigration authority.

• The following documents may be required:
  • Person entitled to asylum, refugee or recognized person in need of subsidiary protection
    • Proof of gainful employment:
      • Employment contract or job offer for employment subject to social insurance contributions for at least 15 hours, which generates at least an income equivalent to the average monthly requirement for an individual in accordance with Book II of the German Social Code
    • Proof of a place of study or training:
      • Training contract or certificate of study
    • to prove the place of residence of the person/partnership/minor child living with you
      • Certificate of registration
      • Marriage certificate
      • birth certificate
    • proof of other reasons to avoid hardship:
      • detailed justification
      • Medical certificate
    • for proof of an integration measure:
      • Certificate of participation in an integration course, a vocational language course according to, a qualification measure of a duration of at least three months leading to professional recognition or a further training measure according to the Third Book of the Social Code
  • Other foreign person
    • Proof of gainful employment:
      
      • employment contract
      • The last three payslips
    • for proof of study or training place:
      
      • Training contract
      • Confirmation from the person providing the work that the training position has been taken up
      • Certificate of study
      • Proof of integration courses
      • Proof of vocational language courses
      • Proof of qualification measures
      • Proof of further training measures
    • to prove the place of residence of the person/partnership/minor child living with you:
      • Certificate of registration
      • Marriage certificate
      • birth certificate
      • Acknowledgment of paternity
      • Joint declaration of custody
    • Other humanitarian reasons
      • z. e.g. medical certificates
      • Detailed written justification

  The responsible immigration authority may request further documents from you in individual cases.

• Person entitled to asylum, refugee or recognized person in need of subsidiary protection:
  
  • Employment subject to social security contributions (at least 15 hours per week and a net income of at least 966.00 (as of June 2025)) or an income that secures a livelihood
  • Training or study place
  • the persons in a marriage with you, your registered civil partnership or the minor child with whom you are related and live or have lived together as a family lives in another place of residence
  • Avoidance of hardship (e.g. humanitarian reasons)
• Other foreign person who is subject to a residence regulation:
  • an income that secures their livelihood
  • Training or study place
  • The person in a marriage with you, your registered civil partnership or the minor child lives in another place of residence
• Other humanitarian reasons

The requirements can also be fulfilled by a family member of the applicant.

Action before the administrative court

• If you would like to apply to change or cancel a residence restriction on your residence permit, you must first submit an application to your local immigration authority.
• The foreigners authority will examine your application and will usually ask the foreigners authority of the new place of residence for approval.
• Once the examination has been completed, you will receive a corresponding decision.

There are no deadlines.

Residence requirement: 50.00 euros; if you receive social benefits, the application is free of charge

Exemption and reduction is possible according to the Residence Ordinance.

You can only move after you have received approval from your previous immigration authority.
