Child daycare facilities; notification of opening, imminent closure, staff notification and special incidents

The competent authority must be notified of the commencement of operation of a facility requiring a permit (stating the name and address of the provider, the type and location of the facility, the number of places available and the names and professional training of the management and care staff).

The competent authority must be notified immediately of any changes to the name and address of the provider, the type and location of the facility, the number of places available and the names and professional training of the manager and care staff as well as the concept.

The number of occupied places must be reported once a year.

The competent authority must be notified of any events or developments that are likely to affect the welfare of children and young people. These can

• Children and young people in care,
• employees of the facility or
• the facilities or parts of the facility

affect them.

The competent authority must be notified of the imminent closure of a facility requiring a permit.

Operation may only commence once an operating permit has been issued (see also "Related topics").

Notifications and reports must be submitted to the competent authority. They can be made informally.

The operating license authority is responsible for the notification in accordance with § 47 SGB VIII. This can be the government or the district administrative authority.

• The governments are responsible for facilities run by an independent municipality or a district.
• For facilities run by independent providers or municipalities belonging to a district, a distinction must be made as to whether Art. 29 BayKiBiG is applicable:
  • if opening hours < 20h/week, then the governments are responsible
  • if opening hours >= 20h/week, then the district administrative authorities are responsible
