Secondary schools; application for school supervisory approval of construction measures

School supervisory approval is required for the construction of new buildings, conversions and extensions to grammar schools, secondary modern schools, technical colleges, technical academies and vocational colleges. The governments are responsible for issuing these.

The school supervisory approval establishes that the building program corresponds to the school's needs and covers the necessary space requirements, taking into account the existing building stock.

School supervisory approval is to be granted if the necessary space requirements for the expected number of pupils and classes in the long term - taking into account the existing building - are covered and the smooth running of the school is guaranteed. In the case of conversions and extensions, approval can already be granted if the realization of the planned construction measures will at least improve inadequate school conditions. The application to be submitted by the cost bearer with the participation of the school must be accompanied in particular by documents on the actual catchment area, unless a school district has been legally established for the school, the number of pupils to be expected in the long term, the school's space requirements on the basis of §§ 3 and 4 of the School Building Ordinance (SchulbauV) with information on the function and size of the planned rooms and areas, the existing building and its future use. The governments are responsible for granting school supervisory approval.

In the case of private alternative schools, the school supervisory approval also includes the approval of the specific construction planning from a school-functional point of view, if funding is to be applied for in accordance with the Bavarian School Financing Act (BaySchFG) (§ 5 sentence 3 of the SchulbauV).
