Membership in the Bayerische Rechtsanwalts- und Steuerberaterversorgung; transmission of information

The Bayerische Rechtsanwalts- und Steuerberaterversorgung grants pension benefits in old age, in the event of occupational disability and to surviving dependants. To do so, it requires certain information from the new member.

The Bavarian Lawyers' and Tax Consultants' Pension Fund (BRAStV) is responsible for

• Lawyers and tax consultants in Bavaria
• Patent attorneys with a registered office in Bavaria, Hamburg, Hesse, North Rhine-Westphalia, Rhineland-Palatinate or Lower Saxony.

The BRAStV is an institution under public law with administrative autonomy and has the task of providing for its members in old age and in the event of occupational disability, as well as for the member's surviving dependants.

The pension fund is part of the statutory pension scheme and thus the first pillar of old-age provision.

Members of the BRAStV acquire their pension entitlement by paying compulsory contributions and/or voluntary additional payments.

Compulsory membership lasts for the entire period of membership in the professional association (for patent attorneys, for the duration of the existence of the registered office in the area of responsibility).

To verify compulsory membership, data must be submitted via the survey form.

There is a very limited possibility of exemption from compulsory membership of the pension fund.

• Compulsory membership of one of the bar associations or chambers of tax consultants in Bavaria
• Compulsory membership of a chamber of patent attorneys and a registered office in Bavaria, Hamburg, Hesse, North Rhine-Westphalia, Rhineland-Palatinate or Lower Saxony
• No occupational disability

Administrative court action

After registration with the professional chamber, the membership data is transferred from the professional chamber to the BRAStV.

At the start of membership in the BRAStV, the new member must complete the "Membership survey form" and send it to the BRAStV. The completed survey form (see under "Forms") can be sent by post or electronically (see under "Online procedure").
The survey form is required for further information relevant to membership, such as the amount of income subject to contributions, possible participation in the SEPA direct debit procedure, affiliation to another pension fund in the profession.

The member will then receive a membership notification from BRAStV by post.

  The data transfer pursuant to Art. 59 para. 1 sentence 5 in conjunction with Art. Art. 4 para. 9 of the Healthcare Professions Chamber Act (HKaG) is carried out by the respective professional chamber to the Bavarian Pharmacists' Association
