Non-mining mineral resources; application for permission to explore

You can apply for a mining permit for the exploration of non-mining mineral resources.

Non-mining mineral resources such as geothermal energy, natural gas and crude oil, ores and coal, salt and brine are not part of real property. For the exploration of these mineral resources, the Free State issues a legal title on the basis of the Federal Mining Act, which is the basis for all activities, the mining permit.

Upon application, the mining permit for the exploration of a non-mining mineral resource is granted for a maximum of five years. Extensions for a further three years are possible if necessary and the exploration work has been carried out as planned in coordination with the Bavarian State Ministry of Economic Affairs, Regional Development and Energy.

The mining permit gives the holder of the right the exclusive right to explore. It is not associated with a specific permit, e.g. for drilling. This requires separate approval procedures. These legal titles provide investment and legal security. The Free State can use them to control exploration accordingly.

Natural and legal persons as well as commercial partnerships are eligible to apply.

The applicant should be familiar with the technical aspects of the exploration, be reliable and be able to provide evidence of the financing of the work.

The application must be submitted to the Bavarian State Ministry of Economic Affairs, Regional Development and Energy in writing or electronically.

The permit card must be submitted in analog form due to its documentary nature.

The relevant authorities in their area of responsibility are involved in the procedure. Expert opinions are requested in complex cases.

Applications should be coordinated in advance with the Bavarian State Ministry of Economic Affairs, Regional Development and Energy, in particular the work program, which should be in line with the raw materials management objectives of the Bavarian State Ministry of Economic Affairs, Regional Development and Energy.
