Anyone who wants to operate a comprehensive system for the disposal of sales packaging needs an official determination.
Upon request, the competent authority shall establish that the system has been set up throughout Lower Saxony.

The determination may be retrospectively accompanied by ancillary provisions necessary to ensure the conditions prevailing at the time of the adoption of the determination on a permanent basis during the operation of the system. The determination shall be publicly announced and shall take effect from the date of its public announcement.

After identification, the free regular collection of used, empty sales packaging from the private end consumer or in his vicinity must be ensured sufficiently and nationwide in Lower Saxony. The packaging recorded in the collection system must be recycled in accordance with the legal requirements. Multiple systems can work together to set up and operate the systems.

The body responsible for waste management may, upon determination or subsequently, require the system operator to provide adequate security that is insolvency-proof in the event that it or its agents fail to fulfil all or part of the obligations laid down in this Regulation and the public waste management authorities or competent authorities are able to claim reimbursement of costs for substitute performance.
