In the area of direct payments to farmers, the notion of cross-compliance plays an important role. It states that farmers (since 1 January 2005) must comply with certain obligations in order to receive direct payments.
There are three areas at stake:
- compliance with statutory management requirements in the fields of public, animal and plant health, the environment and animal welfare;
- the maintenance of good agricultural and environmental condition of the land, and
- the maintenance of permanent pasture.
If some or all of the existing technical regulations for these three areas are not complied with, sanctions will be imposed. Depending on the severity, extent, duration or frequency of the infringements, there will be a reduction of between one per cent and up to 100 per cent of direct payments for one or more calendar years.
Since 01.01.2007, the above-mentioned regulations and some other regulations on phosphate fertilization also apply to recipients of certain area-related payments under the so-called 2nd pillar.
