Show opening of a supplementary school

If you wish to open a supplementary school, you must notify the responsible Regional State Office for Schools and Education (RLSB) in writing. You will receive written confirmation of your notification after the documents have been checked.

Supplementary schools are independent schools that do not serve as a substitute for state schools because comparable schools do not exist in the state school system. They offer school forms and teaching content that the state school system does not know at all or does not know in the respective form. Independent schools are subject to state school supervision. Pupils at supplementary schools are generally required to attend school in full at the alternative school or the relevant state school. This only does not apply if, in accordance with the requirements of § 160 of the Lower Saxony School Act, it has been determined that compulsory schooling is suspended while attending this school.

Supplementary school authorities may be natural persons or legal entities under private or public law (with the exception of regional authorities). The individuals acting as school authorities or representatives or authorized representatives of the school authorities (in the case of legal entities) must be personally reliable. The requirements for the protection of the general public from damage and danger (e.g. structural requirements, hygiene facilities) must be met. The general definition of a school pursuant to § 1 para. 2 sentence 1 NSchG must be fulfilled. Teachers must be sufficiently qualified for the intended teaching activities. The head teacher must have the necessary academic and pedagogical qualifications.

If the establishment of a supplementary school is prohibited, you will receive a decision on this and administrative legal proceedings will be initiated.

This decision will be accompanied by specific instructions on how to appeal, indicating the deadline for taking legal action and the competent administrative court.

The responsible Regional State Office for Schools and Education will check the documents submitted by you and confirm the notification if all requirements are met. Otherwise, the establishment of the supplementary school may also be prohibited in accordance with the provisions of Section 159 (1) of the Lower Saxony School Act.

The amount of the fee is based on the actual administrative costs. The fee range is between € 250.00 and € 2,000.00 in accordance with Section 77.1.5 of the Annex to the Ordinance on Fees and Expenses for Official Acts and Services (General Fee Schedule -AllGO-).
