    The employment of pregnant or breastfeeding women between 8 p.m. and 10 p.m. must be applied for at the local trade supervisory office/the LBEG.

    Description

    If you wish to employ a pregnant or breastfeeding woman between 8 p.m. and 10 p.m., you must obtain permission to do so.

    The supervisory authority may temporarily prohibit you from employing the pregnant or breastfeeding woman during this period in order to protect the health of the woman or her child.

    If the supervisory authority does not temporarily prohibit employment, you may employ the woman between 8 pm and 10 pm.

    If your application is not rejected within six weeks of receipt of the complete application, the permit is deemed to have been granted (fictitious permit)

    No approval is required in the following case:

    The training center may allow pregnant and breastfeeding trainees (§ 1 para. 2 sentence no. 8 MuSchG) to participate in training events until 10 p.m. if

    1. the woman expressly declares her willingness to do so,

    2. participation is necessary for training purposes at this time and

    3. in particular, there is no irresponsible risk to the pregnant woman or her child from working alone.

    Description

    Pregnant and breastfeeding women are also under the special protection of the state in the workplace. With the legally required maternity protection notification, employers inform the competent authority about pregnancies or breastfeeding employees in their workforce.     You can apply for approval in writing:

    • Send your application to the local trade supervisory office/LBEG by post or email, including the required documents and evidence.
    • If the documents or information required for processing are incomplete, you will be contacted immediately by the processing department.
    • The Trade Supervisory Office/LBEG will check the documents.
    • Your application is considered approved if you do not receive a rejection within 6 weeks.
    • If the requirements for approval are not met, you will receive a rejection.
    • The Trade Supervisory Office/LBEG can also issue you with a provisional rejection,
    • In the event of a rejection, you will receive a notice of rejection. You will not receive a notice of approval.
    • The notification of costs will be sent to you once the procedure has been completed.
