Anyone wishing to hold an auction must give prior written notification. An auction must be notified at least 2 weeks before the planned auction date. The notification, including copies of the documents, must also be sent to the responsible Chamber of Industry and Commerce.
Description
The auctioneer must notify each auction at least two weeks before the planned auction date. The notification must be submitted to the competent public order office in whose district the auction is to take place and to the Berlin Chamber of Industry and Commerce. The notification must be made in writing or electronically and contain details of the exact location, time and type of goods to be auctioned.
In exceptional cases, particularly in the case of perishable auction goods, the authority may shorten the two-week notice period upon request.
No notification is required for the auctioning of agricultural inventory, agricultural and forestry products or livestock.
Only used goods may be auctioned. Exceptions are new goods or consumer goods that are sold from an estate, an insolvency estate, by way of business closure or at public auctions on the basis of statutory regulations.

Procedure
You want to hold a commercial auction.
This auction must be notified to the competent authority at least 14 days before the auction date.
The notification of auction must be submitted to the responsible municipality.
The competent authority will check your details and contact you if necessary.
This is a notification, i.e. if you do not receive a refusal/rejection, you can carry out the auction as notified.

Note: Under certain circumstances, the notification period can be shortened. To do this, please submit a separate "Application for exemptions from the Auctioneers Ordinance in the context of notification of an auction". You must submit this application separately because it involves an administrative act.

Processing time
You can start the auction if you have submitted the auctioneer's notification in good time and have not received any notification to the contrary from the competent authority before the auction date.

Subsequent registration of individual auction items is possible if the requirements of Section 3 (2a) of the Auctioneers Ordinance (VerstV) are met.
A new auction may only be started at the location of the previous auction if the previous auction ended at least 5 days ago. An auction may not exceed a duration of 6 days. In individual cases, the competent authority may grant exceptions to the above time limits in accordance with Section 3 (3) VerstV.
