Participate in the creation of a land use plan

The municipalities decide on the preparation of land use plans as part of their municipal planning sovereignty.

In accordance with Section 2 (1) of the Federal Building Code (BauGB), the municipalities are responsible for urban land-use planning and thus the preparation of a land-use plan.

§ Section 1 (3) sentence 2 BauGB clarifies that there is no entitlement to the preparation of a land use plan.

The association municipality administration, in the case of municipalities not belonging to an association, large cities belonging to a district and cities not belonging to a district, the municipal or city administration.

The procedure for drawing up urban land-use plans and thus also a land-use plan is regulated in Sections 3 - 4b of the German Building Code.

The land use plan requires the approval of the higher administrative authority in accordance with Section 6 (1).
