Food retail, mandatory reporting / registration
If you, as the operator of a food business, carry out activities related to the production, processing, storage and distribution of food, you must register with your local food monitoring authority.
Description
Under European law, food business operators are obliged to register if they are not yet registered with the competent authority. Registration takes place with the competent food monitoring authorities of the districts and independent cities.
In addition to registration prior to commencement of activities, the following significant changes must also be reported.
- the closure of the business or
- change in the personal or address details of the food business operator,
- Change of name or address of business premises
- Change in the type of business / activity
- Expansion of the product range
The notification should be submitted within one month of the change occurring.
This applies to every establishment managed or operated by you. All businesses that produce, process, store or distribute food directly or via the internet are subject to registration, regardless of whether they are profit-oriented or not.
Food businesses are for example (list is not exhaustive):
- restaurants, snack bars, kiosks
- artisanal and industrial producers (e.g. bakers, confectioners, butchers)
- Agricultural businesses and winegrowers
- Businesses that only sell food as an incidental part of their product range, such as petrol stations, pharmacies, drugstores and fitness studios that sell food, nutritional supplements or dietary foods as part of their product range
- Businesses that distribute food free of charge, such as food banks
- Businesses that act purely as brokers
- Schools, kindergartens, retirement homes, clubhouses that regularly provide food (refectory, canteen)
- Entrepreneurs who offer food on the Internet. It does not matter whether they sell the food
- on their own homepage,
- via other suppliers or
- on marketplaces such as eBay or Amazon.
- Supermarkets, mini-markets
- Operators of food vending machines
- Producers of food of animal origin
- Fishing, crustacean, shellfish and mollusc businesses
- Wholesalers, transporters, importers and exporters of foodstuffs
- Mobile food trade including sales vehicles
- Primary producers of plant-based foods, such as fruit, vegetables, cereals and herbs
- Party service and catering

The Federal Office of Consumer Protection and Food Safety provides FAQs on obligations as a food business operator.
This is regulated by the EU in accordance with Article 6 (2) of Regulation (EC) No. 852/2004 on the hygiene of foodstuffs. Food business operators are subject to this obligation at all stages of production, processing and trade. In addition to restaurants and snack bars, this also includes businesses that only marginally sell food, such as petrol stations, pharmacies, drugstores and fitness studios. Food business operators also include manufacturers and distributors of consumer goods and cosmetic products.
"Food businesses" are all businesses that are subject to food law, regardless of whether they are profit-oriented or not and whether they are public or private. This means that businesses that distribute food free of charge (e.g. food banks) or that only act as brokers are also subject to registration.
The obligation for food business operators to register also applies to the primary production of plant and animal foodstuffs
When do you have to register?
- When registering a new food business,
- when a food business closes down,
- in the event of significant changes, such as changes to the type of business or the product range.
The notification should be made within one month of the change occurring.

Das Amt Lebensmittelüberwachung und Tiergesundheit ist nur für die Stadt Kassel (Stadtgebiet) zuständig.
Der Landkreis Kassel, Werra-Meißner-Kreis sowie der Schwalm-Eder-Kreis haben eigene Veterinärämter.
Description
Die Aufgaben des Amtes Lebensmittelüberwachung und Tiergesundheit bestehen aus der Überwachung der gesetzlichen Vorgaben auf den Gebieten des Lebensmittel-, Fleischhygiene-, Tierschutz- und Tierseuchenrechts
in der Stadt Kassel. Die Landkreise haben eigene Veterinärämter.
Die Aufgaben des öffentlichen Veterinärwesens umfassen insbesondere:
- Die amtliche Überwachung der Lebensmittel- und Fleischhygiene. Dadurch sollen Verbraucher vor gesundheitlicher Beeinträchtigung, Irreführung und Täuschung geschützt werden.
- Der Tierschutz dient dem Schutz des Lebens und dem Wohlbefinden der Tiere.
- Die Tierseuchenbekämpfung sichert die Gesundheit der einheimischen Tierbestände und soll die Seuchenverbreitung zwischen den Tieren ausschließen beziehungsweise die von Tieren auf Menschen übertragbaren Krankheiten bekämpfen.
Mehrwegverpackungen im Einzelhandel
Ab 1. Januar 2023 sind Lebensmittelunternehmer/innen (z.B. Catering, Lieferdienste, Restaurants) laut Verpackungsgesetz dazu verpflichtet, auch Mehrwegbehälter für Essen und Getränke zum Mitnehmen oder Bestellen anzubieten.
Ausnahmen gelten für kleine Betriebe also mit max. 5 Beschäftigten und max. 80 qm Verkaufsfläche (z.B. Imbissbuden), aber auch diese sollen in mitgebrachte Behälter abfüllen können und die Kundschaft deutlich darauf hinweisen.

Description
Die amtliche Lebensmittelüberwachung ist täglich möglichen Missständen auf der Spur, in Herstellerbetrieben, im Handel und in Gaststätten sowie Einrichtungen der Gemeinschaftsverpflegung.
Mit unangemeldeten Betriebsbesichtigungen und gezielten Probenuntersuchungen achten die Überwachungsbehörden darauf, dass die Regeln des Verbraucherschutzes eingehalten werden. Dabei werden die in Gaststätten und Imbissständen angebotenen Speisen ebenso geprüft, wie die Waren aus dem Supermarkt oder in der Eisdiele von nebenan.
Aufgabe der amtlichen Lebensmittelüberwachung ist es, Verbraucherinnen und Verbraucher vor gesundheitlichen Gefahren durch Lebensmittel, Tabakerzeugnisse, kosmetische Mittel und Bedarfsgegenstände sowie vor Irreführung und Täuschung zu schützen.

Prerequisites

Your business is not yet registered with the competent authority or there have been the above-mentioned changes to the working procedures, conversions or a change of food business operator to the information or data already recorded or you wish to deregister your food business.

Procedure
- Use the form that may be available and send it to the competent food control authority.
- In any case, the required information on the food business must be submitted to the food control authority for registration before the start of operations; in case of doubt, send the required information in writing to the competent food control authority.
- The competent food monitoring authority records the operating data.
- If there are any changes to the information or data already recorded, as described above, or if you wish to deregister your food business, please also contact the competent food monitoring authority.
