Obtain approval from the building inspectorate

Are there any special regulations for the approval of publicly owned construction projects? Do you want to apply for approval for such a construction project?

Construction projects under public ownership require the approval of the building supervisory authority instead of a building permit if it is transferred to a federal or state building department under the direction of the design work and the building department is occupied.  

In certain constellations, the consent requirement may be waived.

Projects that serve the purpose of national defence must be brought to the attention of the higher building supervisory authority in an appropriate manner before construction begins; there is no inspection by the higher building inspectorate.

Lower Building Supervisory Authority (Building Supervisory Authorities of the Districts, Independent Cities and Special Status Cities)

Request for approval and submission of all building documents required for the assessment of the application
 

• The management of the design work is entrusted to a federal or state building department
• The building department must be staffed
   

• You fill out the application digitally in the construction portal or analogue and submit it together with the required documents to the responsible building authority
• The building authority will examine your application and the documents
• If all the requirements are met, the building authority will give you the go-ahead
   

A decision on the application for consent must be made within three months of receipt of the complete application documents.

This period may be extended by up to two months for good cause. If a decision is not taken on the application within the relevant time limit, it shall be deemed to have been granted.

The costs are calculated on the basis of the shell construction sum.
