Large-capacity/heavy-duty transport - permit/exemption

    Description

    Traffic on public roads with vehicles and trains whose dimensions, axle loads or total weights actually exceed the legally generally permitted limits requires a special permit in accordance with § 29 Abs. 3 StVO or approval according to § 46 Abs. 1 Nr. 5 StVO.


    The following case constellations can occur:

    1. If vehicles/vehicle combinations are used during transport whose dimensions, axle loads or total weights exceed the limit dimensions permitted under §§ 32, 34 StVZO, a permit according to § 29 Abs. 3 StVO is required. This may only be issued if the competent authority under state law (in Hesse: Regierungspräsidium) has already granted the exemption from the provisions of the Road Traffic Licensing Regulations (exemption according to § 70 StVZO) required for the vehicle.
       
    2. If the vehicle complies with the permissible limit dimensions and only the load is too long, too wide, too high or protrudes too far forward or rear beyond the vehicle, an exemption according to § 46 Abs. 1 Nr. 5 StVO is required. A prior exemption according to § 70 StVZO is not required.
       
    3. If both the vehicles/vehicle combinations and the load exceed the weight and dimension limits, both a permit according to § 29 Abs. 3 StVO and an exemption according to § 46 Abs. 1 Nr. 5 StVO are required. These are to be applied for jointly and will also be issued in a joint decision.


    The permit according to § 29 Abs. 3 StVO and the exemption according to § 46 Abs. 1 Nr. 5 StVO are generally granted as an individual permit or individual permit. These are valid for a trip with a vehicle or a vehicle combination.

    Under certain conditions, permission or approval can also be granted subject to revocation at any time for a maximum validity of 3 years.

    The application must be submitted via the electronic, internet-based approval procedure VEMAGS. The necessary application forms are stored there.

    Only in exceptional cases can the application for permission be submitted to the locally competent road traffic authority by post, fax or e-mail.

    Deadlines

    The application should be made at least 14 days before the transport is carried out because of the generally necessary hearing; longer deadlines are required for static recalculation of bridge structures.

    Costs

    The fee is based on No. 263 of the Scale of Fees for Road Transport Measures (GebOSt). This is currently between 40 Euro and 1.300,00 Euro.

    Notes (specifics)

    There are special regulations for mobile cranes, concrete pumps and self-propelled work platforms. Further information can be obtained from the locally competent road traffic authorities.

    In the case of large-capacity and heavy-duty transports for the construction of wind turbines, it is imperative that the route is clarified with all authorities involved before submitting the application. Otherwise, considerable delays in the processing of applications are to be expected.
