Applying for an exemption for vehicles and vehicle combinations in accordance with § 70 StVZO
Exemption permits in accordance with § 70 StVZO are required for motor vehicles and their combinations that deviate from the regulations of the StVZO in terms of their dimensions (length, height, width), weights (axle loads, total masses), equipment or in any other way.
Description
Vehicles or vehicle combinations that do not comply with the construction and operating regulations of the Road Traffic Licensing Regulations (StVZO) require a special permit to participate in public road traffic.
As a general rule, exemptions may only be approved if all reasonable possibilities for complying with the provisions of the StVZO and the Vehicle Registration Ordinance (FZV) have been fully exhausted.
Exemptions can be granted for a limited period and locally.
As a rule, exemptions are processed on a case-by-case basis. This means that each permit is only valid for a specific vehicle with a permanently registered vehicle identification number (VIN).
The exemption permits must be documented by the vehicle driver, carried along when driving and handed over to the responsible persons for inspection on request.
Competent office

Procedure
- You can apply for the exemption in writing or online.
- Before you can apply for an exemption for a vehicle, you need an expert opinion from an officially recognized expert for motor vehicle traffic or a technical service recognized for testing complete vehicles of the respective vehicle class.
- The expert opinion must state the necessary exemptions from the StVZO, the suitability of the vehicle or vehicle combination and the requirements and conditions deemed necessary in the interests of road safety. The expert must describe the exemptions in detail and justify their necessity.
- You can then apply for the exemption.
- The competent authority will examine your application and, if the examination is positive, will grant you the exemption.

The processing time depends on the completeness of the application with the enclosed necessary documents and the scope of processing.
Costs
The amount of the fee is based on the scale of fees for road traffic measures (GebOSt). A framework fee is set there for each decision on an exemption from a provision of the StVZO for each exemption and per vehicle/owner. If there are several vehicles of the same design when the application is submitted, a reduced fee can be set. The exact amount of the fee depends on the processing effort and economic advantage for the applicant in each individual case; the fee is set at the discretion of the authority. The amount of the fee also depends, among other things, on the period of validity.
