Exemption permit for vehicles and vehicle combinations over 3.5 t

Individual exemption permits in accordance with § 70 StVZO are required for motor vehicles and their combinations that deviate from the regulations of the StVZO in terms of their dimensions (length, height, width), weights (axle loads, total masses), equipment or in any other way.

Vehicles or vehicle combinations that do not comply with the construction and operating regulations of the Road Traffic Licensing Regulations (StVZO) require a special permit in accordance with Section 70 (1) StVZO in order to participate in public road traffic. In addition to a permanent permit, exemptions can also be granted for individual journeys.

They may only be approved to the extent that is absolutely necessary for the intended purpose (strict standard); no exemption may be granted for economic reasons alone.

Single-trip exemptions can generally be granted for a period of validity of up to two months.

Single-trip exemptions must be documented by the vehicle driver in the form of a document, carried on the vehicle during journeys and handed over to the responsible persons for inspection on request.

As a general rule, exemptions may only be approved if all reasonable options for complying with the provisions of the StVZO and the Vehicle Registration Ordinance (FZV) have been fully exhausted.

The decision of the competent authority shall contain information on the legal remedy.

Before you can apply for an exemption for a vehicle, you need an expert opinion from an officially recognized expert for motor vehicle traffic or a technical service recognized in accordance with Section 30 of the EC Vehicle Approval Regulation (EG-FGV) for testing complete vehicles of the respective vehicle class.

The expert opinion must state the necessary exemptions from the StVZO, the suitability of the vehicle or vehicle combination and the requirements and conditions deemed necessary in the interests of road safety. The expert must describe the exemptions in detail and justify their necessity.

You can then apply for the exemption permit.

The competent authority will examine your application and, if the examination is positive, will grant you the exemption.

You do not have to observe any statutory deadlines when submitting your application.

The fee notices are based on the scale of fees for road traffic measures (GebOSt). A framework fee of between €10.20 and €511.00 is set there for each decision on an exemption from a provision of the StVZO per exemption and per vehicle/owner; if several vehicles of the same design are present at the time of application, a reduced fee may be set. The exact amount of the fee depends on the processing effort and economic advantage for the applicant in each individual case; the determination is at the discretion of the authority. The amount of the fee also depends, among other things, on the period of validity. The local jurisdiction generally depends on your place of residence or the registered office of your company.

In some cases, an additional permit in accordance with § 29 Para. 3 StVO or § 46 Para. 1 No. 5 StVO must be applied for if certain upper limits regarding weight, height or width are exceeded.
