Exemption permits in accordance with § 70 StVZO are required for motor vehicles and their combinations that deviate from the regulations of the StVZO in terms of their dimensions (length, height, width), weights (axle loads, total masses), equipment or in any other way.
Description
Vehicles and vehicle combinations that do not comply with the construction and operating regulations of the Road Traffic Licensing Regulations (StVZO) require a special permit in accordance with Section 70 (1) StVZO in order to participate in public road traffic.
In principle, exemptions may only be approved if all reasonable possibilities for complying with the provisions of the StVZO and the Vehicle Registration Ordinance (FZV) have been fully exhausted.
They may only be approved to the extent that is absolutely necessary for the intended purpose (strict standard); no exemption may be granted for economic reasons alone.
The exemptions can generally be granted for a period of validity of up to twelve years; a time limit is possible.
The exemption permits must be documented by the vehicle driver in the form of a document, carried on board when driving and handed over to the responsible persons for inspection on request.

The report must state the necessary exemptions from the StVZO, the suitability of the vehicle or vehicle combination and the requirements and conditions deemed necessary in the interests of road safety. The expert must describe the exemptions in detail and justify their necessity.

Costs
The fee notices are based on the scale of fees for road traffic measures (GebOSt). A framework fee of between €10.20 and €511.00 is set there for each decision on an exemption from a provision of the StVZO per exemption and per vehicle/owner; if several vehicles of the same design are present at the time of application, a reduced fee may be set. The exact amount of the fee depends on the processing effort and economic advantage for the applicant in each individual case; the determination is at the discretion of the authority. The amount of the fee also depends, among other things, on the period of validity.
