Applying for a partial building permit for the construction of a building structure

If a building application has been submitted, the start of construction work for the excavation pit and for individual parts or construction phases of the project can be approved on application before the building permit is issued (partial building permit). The subject of the partial building permit is on the one hand - as an enacting part - the release of the preparatory construction measures. On the other hand, the partial building permit - as a declaratory part - contains a so-called "provisional positive overall judgment" with regard to the basic approvability of the overall project.

The partial building permit expires if you do not start construction work within three years of the permit being granted or if construction work has been interrupted for one year after this period. The period can be extended by up to two years in each case, even several times, with a written application.

Lower building supervisory authority (building supervisory authorities of the districts, independent cities and special status cities).

A partial building permit can only be issued upon application. This must be submitted digitally in the construction portal or in analog form. All documents required for the assessment must be enclosed with the application. As the scope of the required documents depends on the scope of the construction work to be approved, it is not possible to make general statements in this regard. These must be determined in consultation with the locally responsible lower building supervisory authority.

All required documents and forms have been submitted in full. The project does not conflict with any public law regulations.

An appeal may be lodged against the authority's decision within one month of notification.

• If all requirements are met, the building authority will grant you the permit
