Partial authorisation for the construction of an installation Grant

If you want to build and/or operate part of a new plant, you must apply for a partial permit from the competent authority.

If you want to build and/or operate a part of a plant which, due to its nature or operation, is particularly likely to cause harmful environmental effects or otherwise endanger, significantly disadvantage or significantly nuisance the general public or the neighborhood, you need a partial permit from the competent authority. The authority examines whether there is a legitimate interest in the construction and operation. After a complete examination by the authority, you will receive the decision in the form of a notice.

The partial permit is granted if the fulfilment of the obligations under the Federal Immission Control Act for the sub-project is ensured and if there are no other public law regulations or occupational health and safety concerns to the contrary and a preliminary assessment shows that there are no insurmountable obstacles to the construction and operation of the entire plant from the outset.

The approval procedure requires a written application, which must be accompanied by the drawings, plans, expert opinions and explanations as well as other documents required to check the conditions for approval.

• If your application is complete, it must be made public with the documents, if necessary, and then displayed for one month. In simplified approval procedures or when public participation is waived, there is no public interpretation or discussion meeting.
• At the latest at the same time as the public announcement of the project, the licensing authority shall at the same time invite the authorities to be involved to submit their opinion on the permit requirements within one month.
• If the approval requirements are met, the authority examines whether there is a legitimate interest in the construction and operation of the sub-project.
• A preliminary assessment shows whether there are no insurmountable obstacles to the construction and operation of the entire installation with regard to the conditions for partial authorisation.
• You will receive the notification of approval or rejection of the sub-project.

The binding effect of the preliminary overall assessment does not apply if a change in the factual or legal situation or individual examinations in the context of subsequent partial approvals lead to an assessment that deviates from the preliminary overall assessment, i.e. the granting of further partial approvals or the overall approval may also be refused.
