Applying for revocation of the mining permit
Do you have a permit for the exploration and extraction of mineral resources and would like to have it revoked in whole or in part? Then you must submit an application to the responsible mining authority.
Description
With a mining permit, you are the only person permitted to search for and extract the granted mineral resource in a defined area.
You can have this permit revoked in full or in part, both objectively (individual mineral resources) and spatially. To do so, you must submit an application to the competent mining authority. You do not have to give any reasons for revocation.

Prerequisites
You have a mining license valid at the time of the application to prospect for and extract a specific mineral resource in the licensed area and to acquire ownership of it.

Procedure
You can apply for the revocation online via the "BergPass" platform (if available in the relevant federal state) or in writing or for recording at your competent mountain authority.
Apply for revocation of the permit online via the "BergPass" platform:
- Call up the "BergPass" online platform and log in.
- To register, you will need a bundID and an identity card or residence permit with an active online ID function.
- Call up the application form and fill it out completely and truthfully.
- Upload the required documents as a file and send the application.
Apply for revocation of the permit in writing or for recording at the competent mining authority:
- Contact your competent mining authority and coordinate the required application documents.
- Submit the application and all required documents to your competent mining authority by post or for recording.
Further procedural steps:
- The competent mining authority will check your application and the documents submitted. If any documents are missing, the authority will contact you.
- You will receive a notification by post informing you that your permit has been revoked. In addition, the notification will be sent electronically to the relevant mailbox (bundID or ELSTER company account) in advance and information will be displayed in BergPass.
- The mining authority will announce the revocation in the official publication gazette. Your permit expires to the extent that it is revoked on the date of publication. From this point on, it is no longer possible to withdraw the revocation.
You will also receive a notification of costs. Pay the fees.

Costs
The revocation is subject to a fee in accordance with Section 1 of the Hessian Administrative Costs Act. The fee is between 120 and 100,000 euros in accordance with Section 11102 and 11103 of the administrative cost schedule of the administrative cost regulations for the business area of the Ministry for the Environment, Climate Protection, Agriculture and Consumer Protection. It is based on the personnel and material costs associated with the official act as well as the imputed costs of all parties involved in the official act.
