Applying for the transfer of rights and obligations from the cab permit

Do you want to transfer the permit for your cab business to another entrepreneur? You must submit an application to do this.

You need a permit to transfer the authorization to transport passengers commercially by cab. You can submit a corresponding application to the relevant transport authority.

Contact the responsible traffic authority.

• Valid permit
• Informal justification as to why the cab permit is to be transferred
• Declaration by the permit recipient that he/she agrees to assume the obligations arising from the cab permit
• Application for transfer of the cab permit (surname, first name of the applicant; place of residence and place of business; for natural persons: Date of birth, place of birth; number of vehicles, vehicle type, capacity of the vehicles to be used)
• Certificates of employment or examination certificates (for professional suitability) of the licensee or the person appointed to manage the business of the licensee
• Equity certificate / additional certificate (form in accordance with Section 2 (2) No. 2 / Section 2 (3) of the Ordinance on Access to the Road Passenger Transport Sector PBZugV) of the licensee, not older than 12 months
• Clearance certificate from the tax office, the municipality, the social insurance institution and the employers' liability insurance association for the licensee, not older than 3 months (from the company, the legal representative and the person appointed to manage the business / transport manager of the licensee)
• Certificate of good conduct of the licensee for submission to the authorities in accordance with Section 30 (5) BZRG
• Extract from the central trade register in accordance with Section 150 (5) GewO (for companies) about the licensee
• Extract from the driving aptitude register (FAER) for the licensee

• Vehicle list, if applicable rental vehicles with rental contract or leasing list
• Proof of liability insurance for cabs including risk index (WKZ)
• Proof of installation of an alarm system or exemption permit in accordance with § 25 BOKraft
• Proof of installation of a fare indicator (taximeter) and, if applicable, the last calibration report
• Business registration
• In the case of partnerships, the list of partners, the partnership agreement or other proof of contractual authorization
• certified extract from the commercial register

• The applicant is already in possession of a cab license as an entrepreneur.
• The safety and efficiency of the business are guaranteed.

• There are no facts indicating the unreliability of the applicant as an entrepreneur or of the person appointed to manage the business.
• The applicant as entrepreneur or the person appointed to manage the business is professionally qualified.
• The applicant and the entrepreneurs commissioned by the applicant to provide transportation services must have their registered office or place of business within the meaning of commercial law in Germany.

Legal entities under public law are deemed to meet the requirements.

Proceed as follows to obtain a transfer of the permit for the commercial transportation of passengers by cab:

• Submit a corresponding application to the transport authority responsible for you and enclose all the necessary documents with the application.
• The authority will process your application and carry out the necessary hearing procedures.
• You will receive a decision on the transfer of the cab permit. If applicable, you will receive the certificate of approval.

Deadlines only start to run when an application is ready for a decision. If your application is complete, a decision will be made within 3 months. The deadline can be extended by 3 months if necessary.

The processing time may vary between the competent transport authorities. The processing time may depend, among other things, on whether all documents relevant to the decision have been submitted or whether additional requests for documents are necessary.

The amount of the fees depends on

• the number of vehicles and
• the term of the permit.
