Requesting the transfer of rights and obligations from the rental car permit

Do you want to transfer the permit for your rental car business to another entrepreneur? To do so, you must submit an application.

You need a permit to transfer the authorization to transport passengers commercially with rental cars. You can submit a corresponding application to the transport authority responsible for you.

Contact the responsible traffic authority.

• Valid authorization
• Informal justification as to why the rental car permit is to be transferred
• Declaration by the permit recipient that he/she agrees to assume the obligations arising from the rental car permit
• Application for transfer of the rental car permit (surname, first name of the applicant; place of residence and registered office; in the case of natural persons, date and place of birth; number of vehicles, vehicle type, capacity of the vehicles to be used)
• Certificates of employment or examination certificates (for professional suitability) of the licensee or the person appointed to manage the business of the licensee
• Equity certificate / additional certificate (form in accordance with Section 2 (2) No. 2/ Section 2 (3) of the Ordinance on Access to the Road Passenger Transport Sector PBZugV) of the licensee, not older than 3 months
• Clearance certificate from the tax office, the municipality, the social insurance institution and the professional association of the licensee, not older than 3 months (from the company, the legal representative and the person appointed to manage the business / transport management of the licensee)
• Certificate of good conduct of the licensee for submission to the authorities in accordance with Section 30 (5) BZRG
• Extract from the central trade register in accordance with Section 150 (5) GewO (for companies) about the licensee
• Extract from the driving aptitude register (FAER) for the licensee

• Vehicle list, if applicable rental vehicles with rental contract or leasing list
• Proof of liability insurance for rental cars including risk index (WKZ)
• Proof of installation of an alarm system or exemption permit in accordance with § 25 BOKraft
• Proof of the installation of a odometer
• Business registration
• In the case of partnerships, the list of partners, the partnership agreement or other proof of contractual authorization

• The applicant is already in possession of a cab permit as an entrepreneur.
• The safety and efficiency of the business are guaranteed.
• There are no facts indicating the unreliability of the applicant as an entrepreneur or the person appointed to manage the business.
• The applicant as entrepreneur or the person appointed to manage the business is professionally qualified.
• The applicant and the entrepreneurs commissioned by the applicant to provide transportation services must have their registered office or branch in Germany within the meaning of commercial law.

Legal entities under public law are deemed to meet the requirements.

• Appeal to the administrative court

Proceed as follows to obtain a transfer of the permit for the commercial transportation of passengers by rental car:

• Submit a corresponding application to the transport authority responsible for you and enclose all the necessary documents with the application.
• The authority will process your application and carry out the necessary hearing procedures.
• You will receive a decision on the transfer of the rental car permit. If applicable, you will receive the certificate of approval.

Deadlines only start to run when an application is ready for a decision. If your application is complete, a decision will be made within 3 months. The deadline can be extended by 3 months if necessary.

The processing time may vary between the competent transport authorities. The processing time may depend, among other things, on whether all documents relevant to the decision have been submitted or whether additional requests for documents are necessary.

The amount of the fees depends on

• the number of vehicles and
• the term of the permit.
