Submit emissions declaration according to 11. BImSchV
As the operator of certain installations requiring a permit, you are obliged to declare the air emissions from your installations. You can submit the emissions declaration online.
Description
Air pollutant emissions impair air quality, can form acids in the environment or drive the excessive accumulation of nutrients (eutrophication) in ecosystems. This can also have a negative impact on human health.
As the operator of certain industrial and agricultural businesses that require a permit in accordance with the Federal Immission Control Act (BImSchG) in conjunction with the Ordinance on Installations Requiring a Permit (4th BImSchV), you must submit a periodic emissions declaration to the competent authority on the basis of the Ordinance on Emissions Declarations (11th BImSchV).
According to § 27 BImSchG, this emission declaration contains information on relevant air pollutants, such as
- type
- quantity and
- spatial and temporal distribution of emissions.
An emissions declaration had to be submitted for the first time in the 2008 calendar year. Subsequently, the emissions declaration must be prepared for every fourth calendar year and submitted to the competent authority.
With the decree of June 5, 2008 [Ref.: I 7.1 - 1 a 04.85], the electronic submission of the emissions declaration via the data collection software for operational environmental data reporting (BUBE Online) was introduced in Hesse.
The following requirements must be observed with regard to the obligation to submit an emissions declaration:
- Installations requiring a permit are defined in Annex 1 of the 4th BImSchV.
- Installations subject to licensing that are named in § 1 sentence 1 of the 11th BImSchV are not subject to declaration. However, § 1 sentence 2 of the 11th BImSchV must be observed here, as parts or ancillary facilities of an installation that does not require a declaration may fall under the scope of the 11th BImSchV in their own right and an emissions declaration must therefore only be submitted for these parts or ancillary facilities.
- The emission declaration must be submitted to the competent authority in electronic form by 31 May of the year following the year of declaration by the operators of installations subject to licensing. At the request of the operators, the competent authority may extend the submission deadline in individual cases until June 30 of the year following the year of declaration. The corresponding application for extension must be submitted by the operators to the competent authority by April 30 of the year following the year of declaration at the latest (Section 4 (2) of the 11th BImSchV).
- Operators of installations subject to licensing are obliged to submit an emissions declaration if they have operated their installations during the declaration period (Section 4 (3) of the 11th BImSchV).
- If the installation is commissioned, shut down or temporarily not operated during the declaration period, the declaration period includes the parts of the calendar year in which the installation was operated.
- As the operator of an installation requiring a permit, you can apply to the competent authority to be exempted from the obligation to submit an emissions declaration if, in individual cases, your installation may only emit a small amount of air pollution (Section 6 of the 11th BImSchV).

Prerequisites
- Your installation is subject to licensing in accordance with the Federal Immission Control Act (BImSchV) in conjunction with Annex 1 of the 4th BImSchV.
- The relevant installation number for your installation in Annex 1 of the 4th BImSchV is not listed in
§ 1 sentence 1 of the 11th BImSchV and is therefore obliged to submit an emissions declaration.

Deadlines
- The emissions declaration must be submitted to the competent authority in electronic form every 4 years by May 31 of the year following the year of the declaration.
- In individual cases, the submission deadline can be extended to 30.06. on request. The application must be submitted to the competent authority by 30.04.
