Inspection bodies in waste management Determination for sewage sludge analysis

If you want to work as an investigation body for sewage sludge investigations in waste management, you must be notified (determined) by the competent authority.

If you want to carry out analyses in accordance with the Sewage Sludge Ordinance, you must apply to the competent authority to notify (designate) you as the investigating body. The notification is valid for the entire federal territory.

According to § 6 no. 2 a of the Regulation on the Transfer of Powers of the Land Government for the Adoption of Ordinances and the Determination of Responsibilities in the Areas of Agriculture, Forestry and Nature Conservation (LFNDZustV), the Regierungspräsidium Kassel is responsible for determining the investigating body in Hesse.

After enquiries from the competent authority, further documents may have to be provided. If you operate nationwide, the authority may require you to submit a valid accreditation of compliance with the requirements of DIN EN ISO/IEC 17025:2005, which refers to the parameters and test methods according to Annex 2 AbfKlärV.

You have submitted the application in the country where you have your headquarters. If they are abroad, submit the application in the country where you primarily want to carry out this activity.

You submit an informal application for notification as an investigation body for sewage sludge investigations to the authority of the country in which you have your headquarters. Please attach the required documents. If necessary, the authority will request further application documents. After verification by the competent body, you will receive a written notification as to whether the notification will be made as an investigating body. The authority may make the notification subject to a reservation of withdrawal, a time limit, conditions, obligations and the reservation of conditions.

The examination of the request for notification of an investigating body must be completed within three months; Section 42a (2) sentences 2 to 4 of the Administrative Procedure Act (Verwaltungsverfahrensgesetz, VwVfG) applies.
