Sickness assistance according to §40 SGB VIII Granting
Children or adolescents in foster families or in inpatient facilities of children and youth welfare are entitled to sickness assistance.
Description
For
- Children, adolescents and young adults who are accommodated outside the family within the framework of child and youth welfare,
as well as for
- Mothers or fathers caring for a child under the age of six alone
Sickness assistance - comparable to the benefits of the statutory health insurance fund - applies if there is no other health insurance cover or if it does not fully cover the necessary needs. This means that if these children, adolescents or young adults become ill, the responsible youth welfare office ensures that the costs are covered.
Children, adolescents and young adults who
- living in a foster family
- live in an inpatient facility of child and youth welfare ("children's home")
- in an intensive socio-pedagogical individual care are
- live as a mentally handicapped child or adolescent in a foster family or in an inpatient child and youth welfare facility
- have been taken into custody by the Youth Welfare Office (also temporarily)
- are accommodated in socio-pedagogically accompanied forms of housing during participation in school or vocational training measures or during vocational integration
Mothers or fathers who:
- have to care for a child under the age of six alone and live with the child in a common form of living for mothers/fathers/children, and
Children who
- live together with their mother or father in a common form of living for mothers/fathers and their children
Competent office
The responsibility lies with the Youth Welfare Office.

- A separate application is not required. In order to check the claim, the Youth Welfare Office requests the necessary documents.

Sickness can get help
- Children, adolescents or young adults who live in a foster family or in an inpatient child and youth welfare facility ("Children's Home").
- Children and adolescents whom the Youth Welfare Office has (provisionally) taken into care,
- young people who live in socio-educational forms of housing during their participation in education, vocational training or integration.
- Mothers or fathers who care alone for a child under the age of six and live with the child in a common form of living for mothers/fathers/children
- Children who live with their mother or father in a common form of living for mothers/fathers and children
The important thing is:
- Sickness assistance is only granted if there is no other health insurance cover or if it does not fully cover the necessary needs.
- The persons entitled to custody or the child or adolescent or the young adult are entitled.
Basis for legal action
Procedure
- The responsible youth welfare office checks whether health insurance cover exists elsewhere, for example through family insurance or voluntary continued insurance.
- If there is no priority option of health care or health insurance, the Youth Welfare Office ensures health care (for example, by registering with a statutory health insurance company).

There are no deadlines to be observed.
