    If you want to collect or transport hazardous waste or trade hazardous waste, you must apply for a permit from the competent authority for this activity.

    Description

    If you want to start a waste management activity with hazardous waste, e.g. as a collector, transporter, dealer and broker of hazardous waste, apply for a permit for this activity at the competent authority. If you are exempt from the permit requirement, it is sufficient to report your activity. If you have already obtained a licence to carry out your activity and significant circumstances have changed, you must apply for the licence again. The permit requirement applies to both national and cross-border shipments of waste.

    The environmental departments of the regional councils examine and issue permits for companies that have their headquarters in the respective service district.

    Companies that do not have a head office or branch in Germany can obtain a permit throughout Hesse centrally in the Department of Occupational Safety and Environment of the Darmstadt Regional Council.

    Prerequisites

    The competent authority shall grant authorisation if:

    • no facts are known which give rise to doubts as to the reliability of the owner or the persons responsible for the management and supervision of the business, and
    • the owner, insofar as he is responsible for the management of the business, the persons responsible for the management and supervision of the business and the other personnel have the necessary expertise and expertise for their activities.

    Procedure

    If you wish to take up this activity for the first time as a collector, transporter, dealer and broker of hazardous waste or if essential circumstances of your activity have changed, apply for a permit from the competent authority. By e-mail or using the online form, enter your data and submit the required documents. In the case of the online form, you must sign the application electronically in a qualified manner. For this purpose, for example, the signature card used in the electronic waste verification procedure and the card reader used there can be used. For the signature a signature software from the company Governikus, Signer WebEdition is necessary. The software must be installed locally on your computer system in advance. The download with instructions is available on the GADSYS website. The authority will send you an acknowledgement of receipt. After examining the application and your documents, the authority may:

    • request additional documents or
    • grant permission, with or without ancillary provisions, or
    • refuse permission.

    Costs

    A fee will be charged in accordance with HMUKLV's administrative costs regulations (as amended). Electronically processed procedures are subject to lower fees (800 euros) than written procedures (1000 euros). The specified fees are planned, currently framework fee 200-500 euros.
