Description
You are a creditor of a claim and cannot enforce the debtor's right or property because he or she is not entered in the land register?
The land register is incorrect due to the non-registration of the entitled person.
If you have an enforceable title against the debtor, you can file an application for correction of the land register in accordance with the Land Register Code. This means that the debtor can be entered in the land register as the right holder or owner. With registration, enforcement can be continued.

- Proof that the land register is incorrect - registration authorisation from the person concerned or presentation of the documents proving the inaccuracy (public or publicly certified documents)
- Enforceable title against the unregistered debtor
Prerequisites
- Enforceable title against the enforcement debtor
- Written application by the enforcement creditor
- The land register must be incorrect as a result of the lack of pre-registration of an enforcement debtor entitled in rem.
- The application under the Land Registry Code cannot replace any further approvals, consents or declarations by third parties.
