Attribution of a plot of land in the land register

    If you are the owner of several plots of land and would like them to be registered as a single plot of land in the land register, then you must apply to the competent authority.

    Description

    Are you the owner of several plots of land and would like them to be registered as a single plot of land in the land register?

    You can achieve this by applying to the Land Registry for the attribution of one plot of land to the other plot (main plot).

    From previously independent plots of land, a uniform new property is created, which in some cases can be used more economically.

    Competent office

    Land registry office of the district court where the land registers are kept.

    If the land registers are kept at different land registries, the land registry office which keeps the land register for the main property is responsible for deciding on the application for attribution and, if the application is granted, for keeping the land register for the whole property.

    Required documents

    • Application in publicly certified form, since it also contains the permit according to § 19 GBO, with designation of the properties involved

    Prerequisites

    • Existence of several plots of land or rights equivalent to immovable property
    • Publicly certified application by the owner of the participating properties
    • A plot of land should only be attributed to another property as a component if there is no reason to cause confusion.
      This means, for example, that due to different loads on the properties, the entries can become confusing and difficult to understand. The legal status of the property must always be clearly recognisable.
    • The plots involved should be directly adjacent to each other in the same land register and cadastral district.
    • The owner must be pre-registered.
    • Application of the owner in publicly certified form, as it simultaneously contains the permit according to the land register code and usually replaces the declaration according to the Civil Code , with designation of the land involved.

    Procedure

    If the prerequisites are met, the land registry enters the attribution in the land register.

    Notes (specifics)

    The connected plots lose their independence.

    The plots are registered as one plot in the land register.

    Mortgages encumbered on the main property automatically extend to the attributed property.

    Encumbrances on the attributed property do not extend to the main property.
