Exceeding of action values for the concentration of legionella in service water must be reported to the responsible authority!

As the operator of an evaporative cooling system, a cooling tower or a wet separator, you are obliged to inform the competent authority without delay in accordance with Annex 3 Part 1 of the 42nd BImSchV and within a period of 4 weeks in accordance with Annex 3 Part 2 of the 42nd BImSchV if a laboratory test reveals that the action values specified in Annex 1 of the 42nd BImSchV for the concentration of legionella in service water have been exceeded. The competent authority receives the information and checks the measures initiated by you. If necessary, the authority will also contact you.

The competent authorities are the immission control authorities of the Länder.

In order to inform about the exceeding of a measure value, a registration in the system KaVKA-42.BV is required first. After successful registration and setting of the master data of the workplace (the location of the plant) as well as the plant, information can be given.

If a measure value is exceeded, you are obliged, among other things, to inform the competent authority immediately in accordance with Annex 3 Part 1 and within a period of 4 weeks in accordance with Annex 3 Part 2.
