Apply for a settlement permit
Description
Do you have a temporary residence permit? After a certain period of time, you can obtain a settlement permit that is not restricted in terms of time and place.
The settlement permit allows you to pursue gainful employment. It may only contain ancillary provisions (e.g. a ban on political activity) in exceptional cases and provides special protection against deportation.
Note: Holders of a (temporary) residence permit for the purpose of studying or (vocational) training cannot obtain a settlement permit.

The settlement permit is an unlimited residence title. It entitles you to pursue gainful employment (i.e. also any self-employed activity or any employment).
You must meet the following requirements to be granted a settlement permit:
- You have held a residence permit for five years,
- Your livelihood is secured,
- You have made compulsory contributions to the statutory pension insurance scheme for at least 60 months or can provide evidence of expenses for a claim to comparable benefits from an insurance or pension institution or an insurance company; periods of absence from work due to childcare or home care will be taken into account accordingly,
- You have not committed any relevant criminal offenses (this will be assessed on a case-by-case basis by the immigration authority),
- You are permitted to work if you are an employee,
- You are in possession of the other permits required for the permanent exercise of your gainful employment,
- You have sufficient knowledge of the German language,
- You have a basic knowledge of the legal and social order and living conditions in Germany and
- You have sufficient living space for yourself and your family members living with you in the same household.
Exceptions to no. 3:
- You were already in possession of a residence permit or residence authorization before 01.01.2005,
- your pension is sufficiently secured by a spouse or partner or
- You are in training that leads to a recognized school or vocational qualification.
Exceptions to nos. 7 and 8:
If you were already in possession of a residence permit or residence authorization before 01.01.2005, it is generally only necessary for you to be able to communicate orally in German in a simple manner.
The requirements for the issue of a settlement permit for certain groups of people are governed by other legal bases of the Residence Act.

- Proof of knowledge of the German language,

- Proof of sufficient living space for you and the family members living in the household,
- Proof of ongoing training if you are in training that leads to a recognized educational or vocational qualification

Prerequisites
The requirements for a settlement permit are:
- Your identity has been established and you fulfill the passport requirement.
For the passport requirement, it is sufficient if you have a replacement identity document. - Your livelihood is secured without you drawing on public funds.
Your livelihood is considered secure if you- Income in the amount of the basic social assistance rate plus
- costs for accommodation and heating and
- any health insurance contributions.
- There are no grounds for deportation against you.
- You have no criminal record.
- Your stay does not jeopardize or impair the interests of the Federal Republic of Germany.
- You have had a residence permit for 5 years.
Depending on the purpose of your stay for which you received the residence permit, other time limits may apply. - You have paid contributions to the statutory pension insurance scheme or another pension scheme with comparable benefits for 5 years.
- You are allowed to work and have all the necessary permits to do so.
- You have sufficient knowledge of German and basic knowledge of the German legal and social system.
- You have sufficient living space for yourself and your family.

Basis for legal action
Procedure
You must apply for a settlement permit in writing to the foreigners authority at your main place of residence. Depending on where you live, the foreigners authority is the municipal administration or the district office.
Since 01.09.2011, you will receive the settlement permit in the form of a check card with additional electronic functions. You can find more information on this under "Applying for an electronic residence permit (eAT)".

For Turkish employees and self-employed persons and their family members, the fees for an electronic residence permit are 37 euros or 22.80 euros for those under 24 years of age.
