Immission control - apply for or report industrial plants

The construction and operation of plants require an immission control permit if they are likely to cause particular damage to the environment or endanger the general public.

If you want to build and operate a plant which, due to its nature or operation, is particularly suitable to cause harmful environmental effects or in any other way to endanger, significantly disadvantage or significantly annoy the general public or the neighbourhood, you need a permit from the competent authority. This includes stationary waste disposal facilities for the storage or treatment of waste.

In Hesse, the regional councils issue the necessary immission control permits.

The approval procedure shall be subject to a written application, accompanied by the drawings, explanatory notes and other documents necessary to verify the conditions for authorisation. If the application is complete, it may be necessary. to make the documents public with the documents and then to make them available for one month. In simplified authorisation procedures or if public participation is not used, there is no public interpretation and no hearing takes place. At the latest at the same time as the public announcement of the project, the approval authority shall simultaneously request the authorities to be involved to give their opinion on the permit conditions within one month. If there are objections, they will be discussed with you and those who raised the objections in a public meeting. Once the approval authority has identified all the circumstances relevant for the granting of an authorisation, a decision shall be taken on the application. The approval notice must be justified in writing and will be sent to you and the persons who have raised objections. The notification of the approval decision to objectors may be replaced by public notice.

The operator must have the plant approved by the competent authority before it is built and operated.
