Special use of public traffic areas (roads, cycle paths, footpaths) for work and construction sites
Description
Setting up a work/construction site on a public road is a special use requiring a permit. This requires a traffic law order and/or special permit and a special use permit under road law
The following, for example, are subject to approval
- Construction sites in general (demolition work, structural and civil engineering work, pipeline work)
- Construction trailers or crew/equipment sheds
- Construction fence
- Material storage
- Scaffolding
- Skips and containers
- Lifting platforms
- Truck-mounted crane, construction crane, inclined elevator or cherry picker
- Removals
Note on crane erection:
When using public traffic areas to set up construction cranes or mobile cranes, you must consult the relevant utility companies before using the area.
This is because only the respective utility company can assess whether the lines that may run in the area to be used can withstand the load or whether important work or repairs need to be carried out.

The municipalities are also responsible for federal, state and district roads within the local thoroughfares (§ 17 Hessian Road Act - HStrG -, § 4 Para. 1 Federal Trunk Roads Act - FStrG -).
Outside the local thoroughfares, the Hessen Mobil field offices are responsible. For reasons of administrative simplification, in cases in which a permit for excessive road use or a special permit is required under the provisions of road traffic law, no separate approval is required from the competent road construction authority (cf. Section 16 Para. 7 HStrG, Section 8 Para. 6 FStrG).
Approval is granted by the road traffic authority with the involvement of the police, the civil engineering department and, if necessary, other authorities.

Costs
The amount of the fee for the use of public roads is subject to a scale and depends on the type and duration of use.
The fees range from 10.20 euros to 767.00 euros.
