Applying for a residence permit for the purpose of training

    Description

    Foreign nationals from non-EU and non-EEA countries require a residence permit for training purposes in Germany. You can obtain this for the following courses:

    • Participation in language courses that do not prepare you for university (intensive language course in German)
    • in exceptional cases for school attendance
    • with the approval of the Federal Employment Agency for in-company training and further education

    To study at a state or state-recognized university or comparable educational institution in Germany, you need a "residence permit for students".

    Note: Citizens of EU member states can complete training in Germany on the basis of their right to freedom of movement. They must provide proof of adequate health insurance cover and a means of subsistence if they are not gainfully employed. This also applies to other nationals of the European Economic Area (EEA) and Swiss nationals.

    The residence permit for the purpose of education is limited in time and is only valid for this purpose of residence. If the purpose of your stay changes, you must notify the competent authority immediately. You must apply to extend your residence permit in good time before it expires.

    Please note: If you are staying in Germany for training purposes, you cannot obtain a settlement permit.

    Language course (without subsequent studies)

    A residence permit can be issued for participation in a language course to learn German that does not serve to prepare for studies. However, it must be an intensive language course. Evening and weekend courses do not meet these requirements.

    This means that

    • the lessons must generally take place daily (at least 18 hours per week) and
    • must be aimed at acquiring comprehensive German language skills.

    School attendance

    The general schooling requirements necessary for training in Germany must have been met beforehand (normally in the home country). A stay to attend general education schools is therefore not permitted. Exceptions are possible in special cases.

    Other educational purposes

    It is also possible to stay in Germany for the purpose of vocational training and further education. However, as a rule, you can only obtain a residence permit for the purpose of training and further education with the approval of the Federal Employment Agency or if a statutory order stipulates that training and further education is permitted without the approval of the Federal Employment Agency. This may also be regulated by an intergovernmental agreement.

    In the case of qualified vocational training (the duration of training is at least two years), the residence permit entitles the holder to work up to ten hours per week independently of the vocational training.

    After successful completion of the qualified vocational training, the residence permit can be extended for up to one year in order to look for a job appropriate to this qualification.

    The residence permit entitles the holder to pursue gainful employment during this period.

    Notes

    A residence permit for training purposes is only temporary in terms of its meaning and purpose. Holders of a residence permit for training purposes will therefore not receive a settlement permit even after five years.

    As a rule, you will not be granted or extended a residence permit for any other purpose during your stay for training purposes. However, exceptions are possible (e.g. in the case of legal entitlement).

    It is not permitted to take up work alongside a German course, school attendance or any other educational purpose.

    The granting of a residence permit for educational purposes is at the discretion of the authorities, i.e. you are not entitled to it.

    Prerequisites

    The requirements for obtaining a residence permit are:

    • You fulfill the passport and visa requirements.
      For the passport requirement, it is sufficient if you have a replacement identity document.
    • Your livelihood is secured.
      The assessment limit is the maximum funding rate according to the Federal Training Assistance Act (BAföG).
    • There are no grounds for deportation against you.
    • Your stay does not jeopardize or impair the interests of the Federal Republic of Germany.
    • You meet the admission requirements for the relevant course.

    Procedure

    Before entering Germany, you may need to apply for a national visa in your home country.

    After entering Germany, you must apply for a residence permit in writing to the Foreigners' Registration Office before your visa expires. Depending on where you live, the foreigners authority is the city administration or the district administration.

    Since 01.09.2011, you will receive the residence permit in the form of a check card with additional electronic functions. You can find more information on this under "Applying for an electronic residence permit (eAT)".

    Note: If the approval of the Federal Employment Agency is required (e.g. for in-company training and further education), the immigration authority will obtain this in an internal administrative procedure.

    You would like to complete part of your training here and have already received a residence permit for training purposes in another EU Member State: In most cases, you will also receive a residence permit for Germany.

    You have a residence permit for other purposes (e.g. for family reasons) or a settlement permit: In this case, you can take up training in Germany without an additional residence permit.

    If you complete qualified vocational training in Germany, you may work up to 10 hours per week, regardless of your training. After successful completion of the qualified vocational training, the authority can extend your residence permit by up to one year under certain conditions. During this time

    • you can look for a job appropriate to your degree, provided that it may be filled by foreign nationals, and
    • may work without restrictions.
