The approval of a variety marketed by you or other registered breeders expires? Then you can apply to the Bundessortenamt (BSA) for an extension of the approval.
Description
If the approval of a plant variety marketed by you or other registered breeders expires, any of the registered breeders may apply for an extension of the approval at the Bundessortenamt (BSA). The successful extension will then be registered for all further breeders.
The BSA decides whether an agricultural plant variety will be approved for another 10 years. The approval of vine and fruit varieties can be extended for another 20 years.

Procedure
You can submit your variety approval renewal application to the BSA online, by mail, or by fax.
Online:
- Go to the BSA's website and fill out the application form ("Application for Extension of Variety Approval").
- To be able to use the form, you will need
- your breeder number (will be published in the Plant Variety Bulletin) and
- a password (will be given on request).
- Submit the application online.
By mail or by fax:
- Alternatively, once completed, print, sign, and mail or fax the forms to the BSA.

Deadlines
Application deadline: 2 years (You must submit the application for renewal no later than 2 years before the variety approval expires. An already approved agricultural plant variety is approved for another 10 years, already approved vine and fruit varieties for another 20 years. If the BSA does not make an unappealable decision on an application for extension before the variety approval expires, the duration of the variety approval is extended until the decision becomes unappealable. If the BSA refuses the extension, it may set an expiry date for the recognition and marketing of this variety until June 30 of the 3rd year after the expiry of the approval period at the latest.)

2 years (Extension must be applied for two years before the end of the approval. A decision on the extension will be made at the end of the approval.)

Costs are incurred for the decision on the extension of a variety approval. For the exact fees, please refer to the List of Fees and Expenses of the BMELBGebV (Section 16: Seed Marketing Act and Plant Variety Protection Act).
