Apply for exemption from the obligation to transmit basic data for filling stations and price changes for fuels

    As the holder of price sovereignty (PHI) for fuels, you have a reporting obligation to the Market Transparency Unit for Fuels (MTS-K). Under certain conditions, you can be exempted from the reporting obligation.

    Description

    If you have pricing authority at a filling station, you can be exempted from your obligation to notify the Market Transparency Unit for Fuels (MTS-K). The prerequisite is that:

    • the petrol station in question did not sell more than 750 cubic meters of the fuel types Super E5, Super E10 and diesel in the previous calendar year, or
    • compliance with the reporting obligation would cause unreasonable hardship.

    If you set prices for other filling stations with a higher total throughput, the obligation to register remains in force for these stations.

    The MTS-K will revoke the exemption if your total throughput exceeds 750 cubic meters.

    • Application due to falling below the de minimis limit (de minimis exemption):
      • Application
      • Proof that you have not used more than 750 cubic meters of the fuel types E5, E10 and diesel at the relevant filling station in the previous calendar year:
        • Certificate from a tax consultant (total throughput) or
        • Total invoice (delivery quantity) or
        • Summary of the individual invoices or delivery bills (delivery quantity)

    Prerequisites

    • You are a price authority holder (PHI) for fuels or are acting on behalf of a PHI.
    • You are already registered as a PHI with the Market Transparency Unit for Fuels (MTS-K).
    • The filling station that is to be exempted has not sold more than 750 cubic meters of the fuel types Super E5, Super E10 or diesel in the past calendar year or
    • the price notification means an unreasonable hardship for you.

    Procedure

    You can apply for exemption from the reporting obligation online, by post, e-mail or fax to the Market Transparency Unit for Fuels (MTS-K).

    If you apply for exemption online:

    • Go to the website of the federal portal verwaltung.bund.de and access the online application.
    • Upload the required documents.
    • Submit the application electronically.
    • The MTS-K will check the documents submitted and contact you if there are any queries or additional claims.
    • You will receive a notification by post.

    If you apply for the small claims exemption by post, e-mail or fax:

    • You inform MTS-K in an informal letter for which filling stations you would like to apply for exemption. Please provide the following information for each filling station:
      • Name
      • address
      • Total throughput of fuels in the previous calendar year
      • Company identifier and filling station ID in the form of a Globally Unique Identifier (GUID).
    • Enclose proof of the total throughput for each filling station in the previous calendar year.
    • Send the letter with all the required documents by post, e-mail or fax to the Market Transparency Unit for Fuels (MTS-K).
    • The MTS-K will check your application and contact you if there are any queries or additional claims.
    • You will receive a notification by post.

    If you apply for the hardship exemption by post, e-mail or fax:

    • Let MTS-K know why the notification of price changes represents an unreasonable hardship for you.
    • Please provide the following information for each filling station for which you are obliged to report:
      • Name
      • address
      • Company name and GUID
    • Send the letter with all the required documents to MTS-K by post, e-mail or fax.
    • MTS-K will check your application and contact you if there are any queries or additional claims.
    • You will receive a notification by post.

    Deadlines

    There is no deadline.

    Processing time

    6 weeks to 6 months (Die Bearbeitungsdauer hängt ab von der Art des Anliegens, der Vollständigkeit der Angaben und Nachweise und Ihrer Reaktionszeit bei Rückfragen der MTS-K. Ohne Ihre ausreichende Mitwirkung kann die Bearbeitungszeit 6 Monate deutlich überschreiten.)

    There are no costs.

    Notes (specifics)

    • If the total throughput of the fuel types E5, E10 or diesel at an exempt filling station increases to more than 750 cubic meters in a calendar year, you are obliged to notify the Market Transparency Unit for Fuels.
    • You can also voluntarily waive exemption, even though you fall below the de minimis limit.
