Apply for authorization or exemption for flight, duty and rest times or submit a notification

You must apply for a permit from the Federal Aviation Office (LBA) for flight, duty and rest times. Changes or exceptions are also subject to approval. You must notify the LBA of commanders' decisions involving more than one hour.

Flight, duty and rest times

You require approval from the German Federal Aviation Authority (LBA) for the initial introduction (first application) and amendment (subsequent application) of flight, duty and rest times.

When introducing flight, duty and rest times for the first time (initial application), approval is required for the Organization Management Manual (OMM) Fatigue Risk Management System (FRM/FRMS) to be integrated in the Operations Manual Part A (OM-A). This applies to planned flight services that require Fatigue Risk Management (FRM).

For a subsequent application, you require approval for the OMM-Fatigue Risk Management System (FRM/FRMS) to be integrated in the OM-A for

• planned flight services that require Fatigue Risk Management (FRM),
• a change to the existing OMM Fatigue Risk Management System (FRM/FRMS).

For exceptions (exception request) regarding flight, duty and rest times, you require an exception approval.

The following notifications can be submitted:

• Notification of the commander's decision
  • Exceeding the maximum permitted flight duty time
  • Reduction of the minimum rest period
  • Other notification

Commercial air traffic operations (CAT)

As a commercial air transport operator (CAT), you as an organization can apply for the following in the area of flight, duty and rest times for aircraft or report the following in the area of commander's decisions:

• Initial approval of flight, duty and rest times
• Approval of the revision of flight, duty and rest times
• Approval of the OMM Fatigue Risk Management System (FRM/FRMS) as part of the initial approval of flight, duty and rest periods
• Approval of the revision of the OMM Fatigue Risk Management System (FRM/FRMS) as part of the approval of the revision of flight, duty and rest times
• Exceptional approval regarding flight, duty and rest times
• Notification of the commander's decision
  • Exceeding the maximum permitted flight duty time
  • Reduction of the minimum rest period
• Other notification

As a commercial air transport operator (CAT), you as an organization can apply for the following in the area of flight, duty and rest times for helicopters or report the following in the area of commander's decisions and other:

• Initial approval of flight, duty and rest periods
• Approval of the revision of flight, duty and rest times
• Exemption from flight, duty and rest times
• Extension of flight duty time and reduction of rest time in special cases
• Limitation of flight duty times in helicopter rescue services
• Other notification

Non-commercial flight operations with technically complex motor-powered aircraft (NCC)

As a non-commercial flight operator with complex motor-powered aircraft (NCC), you as an organization or sole proprietorship or other self-employed person can apply for the following in the area of flight, duty and rest times for aircraft and helicopters or report the following in the area of commander decisions and other:

• Initial approval of flight, duty and rest periods
• Approval of the revision of flight, duty and rest times
• Exemption from flight, duty and rest periods
  • Extension of flight duty time and reduction of rest time in special cases
  • Exceptions for special flights
• Notification of the commander's decision
• Other notification

Initial approval and approval of changes to flight, duty and rest times:

• Approval of the Organization Management Manual (OMM) Fatigue Risk Management System (FRM/FRMS) required as part of the initial approval of flight, duty and rest times:

• Applications can only be submitted by CAT, NCC and SPO operators based in Germany.
• In the case of CAT operators, an AOC (Air Operator Certificate) must be available or applied for.
• In the case of NCC and SPO operators, a declaration must have been submitted.
