Apply for changes to German air carriers

    If you wish to make changes to your German air carrier under commercial and company law, you must report and apply for these changes.

    Description

    As a German air carrier, you must report and apply for changes in your company to the Luftfahrt-Bundesamt (LBA) under certain conditions.

    You can apply for the following changes to your German aviation company under commercial and company law:

    • Change of name
    • Change of registered office
    • Changes in the management
    • New legal form
    • other changes under commercial or company law

    You must prove and confirm the changes with suitable documents, depending on the matter in question. You must be a member of the company to submit the application. Costs may be incurred for the change to your air carrier.

    After checking the notified change, you will receive from the LBA

    • a notification,
    • the amended operating license and
    • if applicable, the amended Air Operator Certificate (Air Operator CertificateAOC).

    Required documents

    General:

    • Resolution of the shareholders on the amendment
    • Entry in the commercial register

    in the case of changes under company law:

    • New list of shareholders
    • Proof of citizenship or copies of identity documents of the shareholders
    • Further evidence may be required to prove the continued majority European shareholder participation in the ownership and control of the airline. Depending on the complexity of the company structures, these will be requested subsequently.

    in the event of a name change:

    • updated insurance certificates for all aircraft
    • amended proof of ownership or amended lease and ownership agreements or a declaration by both contracting parties that the existing agreements for all aircraft remain unchanged

    in the event of changes in the management:

    • to be submitted by post: police clearance certificates of the new managing directors for submission to an authority that are no more than 6 months old

    You do not have to submit certain documents at the time of application - you can submit these documents later.

    Prerequisites

    • You can only apply for the change as a member of a German airline with a valid operating license.
    • Objection
      You can lodge an objection within 1 month.

    Procedure

    You can apply to change a German air carrier online or by post, e-mail or fax.

    Online application:

    • Go to the federal portal verwaltung.bund.de and complete the online application.
    • You can upload your documents directly.
    • You will probably not have all the information available at the start of the application. You can therefore add missing information and submit additional documents during the application process.
    • The LBA will then check whether your air carrier still meets all the necessary approval requirements.
    • If there are any uncertainties or missing information, the LBA will contact you.
    • Once your application has been processed by the authority, you will receive a final decision and notification of fees.
    • After you have paid the fees, you can retrieve the decision in your BundID account and you will receive your amended operating license and, if applicable, the amended Air Operator Certificate (AOC) by post.

    Application by post, e-mail or fax:

    • Call up the forms on the LBA website.
    • Complete the forms and compile the required documents.
    • Send all documents to the LBA.
    • The further procedural steps are the same as for the online application.

    There is no deadline.

    2 to 12 weeks (Note for further information on the processing time: The processing time depends on how quickly the required information and documents can be sent to the LBA.)

    Costs

    Note: Costs if you request a change to your carrier. If you report the change to the management, you will not incur any costs.: Fee from 250,00 EUR to 3.000,00 EUR
