State regulatory authority
With the new regulation of the energy industry law of 7 July 2005, the Federal Network Agency and the state regulatory authorities are responsible for the regulation of electricity and gas network operators. The regulation of electricity and gas supply networks serves to ensure effective and undistorted competition in the supply of electricity and gas.
About us - Regulation of the electricity and gas grids
The regulatory authorities are the Federal Network Agency and the state regulatory authorities. Pursuant to Section 54 of the Energy Industry Act, the state regulatory authorities are responsible for regulating grid operators whose electricity or gas distribution grid is connected to fewer than 100,000 customers and whose grid does not extend beyond the territory of the state. In the State of Hesse, around 40 electricity and gas grid operators are subject to regulatory supervision by the state; the Federal Network Agency in Bonn is responsible for electricity and gas grid operators whose grids extend beyond the borders of Hesse or to whose grids 100,000 customers or more are connected.
The tasks of the state regulatory authority include, in particular, setting the revenue caps for electricity and gas grid operators, monitoring the regulations on unbundling and monitoring the abuse of energy grid operators.
The regulatory authorities exercise their powers in accordance with Article 57 of Directive (EU) 2019/944 of the European Parliament and of the Council of 5 June 2019 concerning common rules for the internal market in electricity and amending Directive 2012/27/EU (OJ L 158, p. 125) and Article 76 of Directive (EU) 2024/1788 of the European Parliament and of the Council of 13 June 2024 on common rules for the internal market in electricity . In accordance with Article 76 of Directive ( EU) 2024/1788 of the European Parliament and of the Council of 13 June 2024 on common rules for the internal markets in renewable gas, natural gas and hydrogen, amending Directive (EU) 2023/1791 and repealing Directive 2009/73/EC (OJ L, 2024/1788) , the national regulatory authority carries out its activities impartially, transparently and independently of instructions.
Pursuant to Article 2 of the Act on the Establishment of the Hesse Regulatory Chamber of 27 May 2013 (GVBl. No. 10 of 4 June 2013), the state regulatory authority is the Hesse Regulatory Chamber (see download for the text of the Act).
