Recognition as a market surveyor

    Description

    If you wish to carry out activities in Hesse that are reserved for mine surveyors under the Federal Mining Act (BBergG) or other legal regulations (e.g. managing the mine workings of mining operations, drawing up mine property surveys, determining a new angle of action of underground mining operations), you must be recognized as a mine surveyor.

    Recognition is not required if you are already recognized as a mine surveyor in another state of the Federal Republic of Germany.

    Prerequisites

    In order to be recognized as a mine surveyor, you must

    • be qualified for the higher civil service in the field of mine surveying (in particular, have passed the state examination in the field of mine surveying); an examination taken outside the Federal Republic of Germany is equivalent to the qualification for the higher civil service in the field of mine surveying, provided that the type and scope of the training and examination correspond to the training and examination for the higher civil service in the field of mine surveying. If the training and examination are not equivalent, recognition may be made dependent on the completion of supplementary training and the passing of an additional examination.

    Deadlines

    If no decision is made on the application for recognition as a Markscheider within 3 months, it is deemed to have been granted. Otherwise, § 42a of the Hessian Administrative Procedure Act applies

    Costs

    A time fee is charged for recognition, depending on the personnel required to process the application.

    Notes (specifics)

    Recognition shall be refused if facts justify the assumption that the applicant does not possess the reliability required for the work of a mine surveyor or is permanently incapable of carrying out the work of a mine surveyor due to a weakness of physical or mental strength.

    Recognition as a mine surveyor may be revoked if the mine surveyor does not carry out the mine surveying and other surveying work in connection with activities and facilities pursuant to § 2 of the Federal Mining Act in accordance with the rules of mine surveying and surveying or the corresponding regulations or orders of the Darmstadt Regional Council as the mining authority or does not submit the notifications and reports which he is obliged to submit to the Darmstadt Regional Council as the mining authority.

    The recognition expires if the mine surveyor waives it vis-à-vis the Darmstadt Regional Council as the mining authority.
    If facts justify the assumption that the requirements for recognition as a mine surveyor in Hesse are not met, the Darmstadt Regional Council as the mining authority may restrict or prohibit a recognized mine surveyor from carrying out his activities.
