Commercial passenger transport - Authorisation

The carriage of persons by motor vehicle, whether for remuneration or on a commercial basis, is subject to authorisation. Occasional motor vehicle services, which differ from regular motor vehicle services, are discussed in more detail here.

Forms of occasional services are:

• traffic with taxis,
• excursions and holiday destinations by car and bus (KOM),
• Transport with rental cars and rental buses.

An authorisation may be granted only if the following conditions are met:

• The safety and efficiency of the operation must be guaranteed.
• The applicant or the person entrusted with the management of the business must be of good repute.
• The applicant or the person entrusted with the management of the business must be professionally suitable.
• The applicant must have his place of business or establishment within the meaning of commercial law in Germany.

Permits for occasional services by coach and coach are issued by the regional council responsible for the company's registered office (Darmstadt, Gießen or Kassel).

Permits for commercial occasional services with passenger cars (with a maximum of 9 seats incl. driver) are issued in municipalities with 7,500 or more inhabitants by the municipal board, otherwise by the district committee.

• Application (form is available on the website of the responsible regional council):
  Extract from the commercial or cooperative register, if a corresponding entry exists
• Proof of authorization to represent the company
• Certificate of good conduct
• Information from the central trade register for the owner and legal representatives
• Proof of financial capacity by submitting clearance certificates from the tax office, the municipality, the social insurance institution and the employers' liability insurance association, the reference dates of which must not be more than 3 months in the past at the time of application, as well as equity certificates, if applicable with additional certificates, the reference dates of which must not be more than one year in the past at the time of application
• Proof of professional suitability
  Certificate of professional competence in road passenger transport
  Certificate of professional competence in cab and hire car transport
• Vehicle list
• Possibly partnership agreement

If a person has been appointed to manage the business, the following must also be submitted for this person

• Proof of employment
• Certificate of good conduct
• Information from the central trade register
• Proof of professional suitability
  Certificate of professional competence in road passenger transport
  Certificate of professional competence in cab and hire car transportation

The certificate of good conduct and the information from the central trade register must not be older than 3 months.

A permit is granted for a maximum period of 5 years.

The fee is levied in accordance with the Costs Ordinance for Official Acts in the Carriage of Persons with Motor Vehicles (PBefGKostV), whether against payment or in business. The amount depends on the administrative burden and the value of the subject matter of the official act.
