Submit measurement report on continuous measurements of air pollutants at plants for the incineration and co-incineration of waste

    If you operate a waste incineration plant or a combustion plant in which you co-incinerate waste, you must continuously measure, record and evaluate the pollutant emissions and prepare an annual measurement report on the results and submit it to the competent authority.

    Description

    The Federal Immission Control Ordinance stipulates the conditions under which your company must submit a measurement report.

    If your company is obliged to submit a measurement report, you must prepare a measurement report for each calendar year.

    You can commission an accredited measuring institute or an expert to do this.

    Your measurement report must contain the following data, among others

    • the mass concentrations of certain emissions
    • the volume content of oxygen in the flue gas and
    • the operating parameters required to assess proper operation, in particular
      • exhaust gas temperature,
      • exhaust gas volume flow,
      • moisture content and
      • pressure.

    In Hesse, the measurements must be carried out by a notified body.

    Prerequisites

    • You operate a waste incineration or waste co-incineration plant that requires a permit.
    • You have put your plant into operation.

    The administrative service is a real act against which no legal remedy is possible.

    Procedure

    Submit your measurement report in accordance with the specifications of the authority responsible under state law:

    • For ongoing measurements, contact your responsible immission control authority. They will provide you with details on the type and scope of the necessary investigations.
    • You evaluate the continuous measurements of the respective calendar year.
    • You prepare a measurement report on the results.
    • You send your measurement report to the immission control authority responsible for you by March 31 each year.
    • You can commission an accredited measuring institute or an expert to evaluate the continuous measurements and/or prepare the measurement report.

    In Hesse, fees for the official inspection of measurement reports are charged on a time basis.

    Notes (specifics)

    You are committing an administrative offense if you:

    • do not carry out continuous measurements,
    • do not evaluate measurements, do not evaluate them correctly or do not evaluate them completely,
    • do not submit the measurement report, or do not submit it correctly, completely or on time,
    • do not keep the measurement report and the records of the measuring devices for at least 5 years.
