You would like to use a plant protection product on your farm that is not authorised for use in this crop. Then you need a case-by-case operating permit, which must be applied for at the official plant protection service.
Description
Plant protection products may only be used if:
- the funds are authorised
- the authorisation is not suspended and only
- in the valid indications specified in the authorisation (culture and harmful organism)
- in accordance with the applicable rules of use laid down in the authorisation.
In many horticultural crops, which are grown only on a small scale, but also in special agricultural crops, the use of plant protection products is limited or not given, since there are usually only a few approved products for this. However, the problem of "control gaps" can also exist for certain harmful organisms which cause damage only sporadically and in certain areas worthy of control and have therefore not been taken into account in regular authorisations.
In these situations, an operational authorisation for the use of an authorised plant protection product in an additional indication may be applied for on a case-by-case basis. The validity of a permit is always limited to the applicant holding and the area applied for. It may be subject to additional requirements.

Prerequisites
- Crops which are grown on a small scale are eligible for authorisation, or
- against harmful organisms causing significant damage only in certain areas
- Authorisations can only be granted for authorised plant protection products
- Application rates and number of applications shall not exceed those for an approved indication
- Plant protection products may only be authorised for the area of use corresponding to the authorisation (e.g. field, greenhouse)
- Food derived from these plants or plant products may contribute only marginally to the daily diet
- for plants and products thereof used for human consumption: no exceedance of the expected statutory maximum residue levels of the active substance when used as intended and appropriate
- Eligible to apply are agricultural, horticultural or forestry businesses that use plant protection products for commercial purposes or in the context of other economic undertakings. In addition, legal entities (e.g. cultivation associations) can submit collective applications for their members.
- The validity of a permit is always limited to the applicant holding and the area applied for and may be subject to additional conditions.
- authorisation for seed treatment may be granted only if the treated seed is used exclusively on the holding's own holding.
Authorisation may be applied for by:
(a) persons using plant protection products in commercial horticulture, agriculture and forestry;
b) Legal persons whose members belong to the above-mentioned group of persons

Procedure
Prior consultation on the eligibility of the intended use and possible alternatives is recommended.
The application is submitted using the respective form to the responsible official body of the federal state in which the areas in question are located. The data collected in the application are of fundamental importance in the authorisation process and must therefore be correct and complete.
The Office shall verify the completeness, accuracy and accuracy of the application information and the fulfilment of the conditions for authorisation. If there are any queries or additional claims, you will be contacted.
Authorisation shall be granted by means of a decision subject to a fee. It shall apply only to the applicant holding and to the areas applied for.
Costs
Variable:
- 50 euros plus 15 euros per indication
- Collective application: 50 euros plus 15 euros per indication plus 15 euros per user
Notes (specifics)
The authorisation shall expire on expiry of the general authorisation of the plant protection product concerned or after a maximum of 3 years.
The use of plant protection products is in most cases regulated by an authorisation procedure. In addition to this approval procedure for plant protection products, there are various approval procedures.

Bemerkungen
- There is no legal entitlement to the granting of a permit.
- The user bears the risk with regard to efficacy, residues on the crop and crop compatibility.
- The uses of the authorised plant protection products shall be documented.
