Description
As the operator of an upper-tier operating area, you are obliged to provide the competent authority with the information required to draw up external alarm and emergency plans. The aim of transmitting information is to ensure effective emergency response by interlinking internal and external alarm and emergency response planning. For this reason, cooperation between the operator and the authorities responsible for civil protection and general emergency response should already take place during the development and each update of the internal alarm and emergency response plans.
It is imperative that operators and authorities work together to define the external hazard areas.
After preparation and each update, the content of the internal alarm and emergency plans must be communicated to the authorities responsible for civil protection and general emergency response, insofar as it is necessary for these authorities to fulfill their tasks. As part of the cooperation, it should therefore be discussed which documents should be forwarded to the authorities in detail with regard to their distribution of tasks.

The scope of the documents to be submitted is determined by the provisions of the 12th BImschV, the HBKG or the StrlSchG and the StrlSchV.

This administrative service does not constitute an administrative act. For this reason, there is no legal remedy.
Deadlines
The deadlines for the transmission of the information required for the preparation of external emergency plans by the operator are set out in the Major Accidents Ordinance and are at least one month before the commissioning of an operating area or before changes to the installation or activities that bring the operating area under the scope of the said Ordinance. Or if an operating area of the lower class becomes an operating area of the upper class.
According to StrlSchG, the documents must also be made available before the license is used.
