Competent person for testing protection against hazards from explosions and fires Recognition

Official approval of persons who have the qualifications and reliability required for the testing task as well as the necessary testing equipment.

This administrative service includes the official recognition of a competent person for the testing of

• devices,
• protective systems or
• safety, control or regulating devices within the meaning of the ATEX Directive (2014/34/EU)

after a repair with regard to a part on which explosion protection depends.

The Darmstadt Regional Council is responsible for this.

Details of the applicant

1. Address of the operating site or the operating department in which the qualified person recognized by the authority is to work
2. Details of the contact person for queries
3. Testing tasks and scope for which recognition is requested
4. Proof of the need for testing and details of the devices to be tested, the protective systems, safety, monitoring and control devices that are to be tested after repair
5. Declaration by the applicant that the person authorized to perform the test is not subject to instructions
6. if available, certification certificate for a quality assurance system or details of the quality assurance procedure

Details of the qualified person

1. First name and surname
2. Date and place of birth,
3. occupation
4. Private address of the applicant
5. Copy of the employment contract between the applicant and the person qualified for the examination
6. Curriculum vitae of the applicant with details of the professional career and professional practice up to the time of application as well as copies of certificates of previous employment relationships
7. Copies of the certificate of skilled work, the master craftsman's certificate and diploma, the diploma certificate and diploma or comparable proof of qualification
8. Copies of certificates of participation in further training courses, relevant exchanges of experience
9. Police clearance certificate, document type 0
10. Declaration by the person authorized to conduct the examination that they are not subject to instructions.

Expert opinion from an expert:

After the scope of the examination has been determined by the recognition authority, the applicant commissions an expert to submit an expert opinion. This statement relates to the technical and organizational requirements of the company and the examination of the personal suitability of the applicant and his skills and knowledge of the relevant legal standards for the corresponding test work. If the applicant has been accredited as a testing laboratory or inspection body in accordance with the DIN EN ISO/IEC 17000 series of standards, the scope of the expert opinion and, if applicable, the sample test will be adapted accordingly.

Written confirmation from the insurer of existing liability insurance in the amount of EUR 2.5 million for the activities of the recognized person qualified to carry out the inspection in accordance with the declaration of exemption.

• Completed technical vocational training or proof of another technical qualification of the person to be recognized that qualifies them for the intended testing task
• Practical experience of the person to be recognized with comparable work equipment over an appropriate period of time, so that the assigned testing task is performed reliably
• Activity of the person to be recognized in the environment of the upcoming inspection of the work equipment to be inspected as well as appropriate further training
• Expert opinion on the qualifications of the person to be recognized and on the equipment and quality assurance of the company
• Proof of the regular need for such inspections

2. Not online: Inspection of the establishment and the test workplace by the certifying authority and determination of the scope of the expert opinion by the certifying authority
3. Commissioning of the expert by the operator
4. ONLINE: Submission of the expert opinion to the recognition authority
5. Notification of recognition or rejection
